These charges arose from a scheme to impede the federal criminal investigation into fraud and corruption at MCU, a non-profit, multibillion-dollar financial institution, including misconduct committed by Kam Wong, the former chief executive officer (“CEO”), and Joseph Guagliardo, a former New York City Police Department Officer and member of MCU’s Supervisory Committee. Wong and Guagliardo were charged separately and previously pled guilty to embezzlement from MCU. ASH was convicted in December 2021 after a two-week jury trial before U.S. District Judge Lewis A. Kaplan, who imposed today’s sentence. </p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">U.S. Attorney Damian Williams said: “While serving as a sitting state judge, Sylvia Ash took repeated steps, over multiple months, to seek to obstruct the federal criminal investigation into misconduct at MCU that took place during Ash’s tenure as chair of its Board of Directors. Ash agreed to do so with the now imprisoned former CEO of the credit union, who provided her with a steady stream of benefits from MCU, including after she was directed to resign from MCU’s board. Today’s sentence sends a clear message that those who attempt to thwart a federal investigation face serious consequences for that corrosive conduct.”</p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">In pronouncing the sentence, Judge Kaplan said ASH’s “crimes struck at the heart of the criminal justice system.”</p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">According to the Complaint, Indictment, Superseding Indictment, publicly available information, court filings, and evidence presented during the trial in Manhattan federal court:</p><p align="center" style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;"><i style="box-sizing: inherit;">Municipal Credit Union</i></p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">MCU is a non-profit financial institution headquartered in New York, New York, which is federally insured by the National Credit Union Administration (“NCUA”). MCU is the oldest credit union in New York State and one of the oldest and largest in the country, providing banking services to more than 590,000 members, and with more than $4.2 billion in member accounts, each of which is insured for at least $250,000 by the National Credit Union Share Insurance Fund, which is administered by the NCUA. Membership in MCU is generally available to employees of New York City and its agencies, employees of the federal and New York state governments who work in New York City, and employees of hospitals, nursing homes, and similar facilities located within New York State.</p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">At all relevant times, MCU was overseen by a Board of Directors (the “Board”) and a Supervisory Committee, each of which was composed of members of MCU, who were not supposed to be compensated. As a result of severe deficiencies in the Board’s and the Supervisory Committee’s oversight of the credit union, which came to light in connection with the federal investigation, the New York Department of Financial Services (“DFS”) removed the members of the Supervisory Committee in May 2018 and the Board in June 2018. Subsequently, DFS appointed NCUA as the conservator for the credit union. In or about February 2022, MCU successfully emerged from conservatorship under new leadership.</p><p align="center" style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;"><i style="box-sizing: inherit;">ASH</i></p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">ASH served as a judge in the New York State court system from approximately 2006 through March 2022, first as a Kings County Civil Court Judge, and then, starting in 2011, as a Kings County Supreme Court Justice. In or about January 2016, ASH was appointed as the presiding judge in the Kings County Supreme Court’s Commercial Division. After the charges in this case were unsealed, ASH was suspended from her position. In or about March 2022, after ASH was convicted, she vacated her judicial office. </p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">ASH served on MCU’s Board from in or about May 2008 until on or about August 15, 2016, when she resigned. From in or about May 2015 until her resignation, ASH served as the chair of the Board. ASH resigned after a complaint was filed against her by the New York State Commission on Judicial Conduct arising from a conflict of interest between her position as a state judge and her membership on MCU’s Board. More than a year before her resignation, ASH had been instructed to resign from MCU’s Board by the Advisory Committee on Judicial Ethics, which instruction she disregarded.</p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">From at least in or about 2012 through 2016, while serving as an MCU Board member and while Wong was CEO, ASH received annually tens of thousands of dollars in reimbursements and other benefits from MCU, many of which were personal in nature, and not business-related, including airfare, hotels, food and entertainment expenses for her and a guest to attend conferences both domestically and abroad, annual birthday parties at a minor league baseball stadium, payment for phone and cable bills, and electronic devices. Even after her resignation from the Board, Wong continued to provide or cause MCU to provide ASH with benefits, such as Apple devices and sports tickets. As a sitting state judge, ASH was required to report both her board service and gifts and benefits she received from any outside sources on an annual state disclosure form. But between at least 2012 and 2018, ASH never reported her board service nor any gifts or benefits from MCU.</p><p align="center" style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;"><i style="box-sizing: inherit;">ASH’s Obstruction of Justice</i></p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">In January 2018, after Wong, MCU’s then-CEO, had been approached by federal law enforcement agents investigating apparent financial misconduct by Wong, in an attempt to protect Wong, ASH agreed to and did sign a false and misleading memorandum purporting to explain and justify millions of dollars Wong had received from MCU. Wong subsequently provided that false and misleading memorandum to federal agents in an attempt to demonstrate that the millions of dollars had purportedly been orally approved for him to receive by ASH in June 2015, when she was chair of the Board. However, in truth, neither ASH nor the Board had approved the payment of those funds.</p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">On March 1, 2018, shortly after Wong was placed on administrative leave by MCU, ASH was interviewed about the memorandum she signed for Wong. During that interview, ASH admitted that the memorandum was not accurate, but attempted to justify the money that Wong received by stating that MCU’s then-current general counsel had told her that Wong’s employment contract gave him the option of receiving such money. That statement was false.</p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">On March 13, 2018, ASH was served with a federal grand jury subpoena (the “First Subpoena”), which required the production of documents related to various matters, including Wong’s compensation, and any communications with Wong through the date of the First Subpoena. On April 6, 2018, during a telephonic interview with a federal agent, ASH falsely stated that she did not have any materials responsive to the First Subpoena.</p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">On June 8, 2018—after Wong was charged with embezzlement from MCU and the Government executed a judicially-authorized search of the residence of Guagliardo—ASH was interviewed by telephone for a second time about the First Subpoena. During that interview, ASH again falsely stated that she did not have any materials responsive to the First Subpoena. </p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">On June 18, 2018, ASH was served with a second federal grand jury subpoena (the “Second Subpoena”), which required the production of, among other things, all correspondence with Wong and Guagliardo; all documents regarding any criminal investigation, internal investigation, or audit related to Wong; and all documents regarding items of value ASH received from MCU, Wong, or Guagliardo. Shortly afterward, ASH went to an Apple store and wiped an iPhone X that Wong had provided her in January 2018. In addition, ASH deleted emails from her Gmail account, including all of her emails with Guagliardo, none of which she produced in response to either of the two federal grand jury subpoenas directed to her. ASH also later wiped two MCU-issued iPads she had received.</p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">On July 6, 2018, on ASH’s behalf, her then-counsel produced materials to the Government in response to the Second Subpoena. This production was materially incomplete, and did not contain text messages, emails, and other documents ASH possessed or had under her custody or control that were responsive to the Second Subpoena.</p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">On July 9, 2018, ASH attended a voluntary interview with the U.S. Attorney’s Office. During this interview, while accompanied by her then-counsel, ASH made multiple false statements, including repeating false statements regarding her purported conversations with MCU’s former general counsel about Wong’s receipt of cash payments and falsely claiming that she and her aunt took a trip to Las Vegas paid for by MCU, including airfare, lodging, and entertainment expenses, after she resigned because all of her travel arrangements were paid for by MCU before she resigned, when in truth all of the expenses were paid for after she resigned. </p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">On or about October 11, 2019, ASH was arrested, and her cellphone was seized. After obtaining a judicially authorized search warrant, ASH’s phone was searched, which revealed, among other things, numerous text messages, including with Wong and Guagliardo, that were concealed in response to the First and Second Subpoenas.</p><p align="center" style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">* * *</p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">In addition to her prison term, ASH, 64, of Brooklyn, New York, was sentenced to a $80,000 fine, and two years of supervised release, including a special condition of twenty hours of community service per week while on supervised release. The court reserved the decision on restitution to MCU. </p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">On June 4, 2019, Wong was sentenced to 66 months’ imprisonment for embezzlement from MCU and was ordered to forfeit $9,890,375 and to pay restitution in the same amount to MCU.</p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">On July 23, 2020, Guagliardo was sentenced to 27 months’ imprisonment for embezzlement from MCU and was ordered to forfeit $425,514 and to pay $468,189 in restitution to MCU. </p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">U.S. Attorney Williams praised the outstanding work of the Special Agents of the United States Attorney’s Office. Mr. Williams also thanked the New York County District Attorney’s Office and DFS for their assistance.</p><p style="box-sizing: inherit; line-height: 1.5; margin-bottom: 1rem; word-break: break-word;">The case is being handled by the Office’s Public Corruption Unit. Assistant U.S. Attorneys Eli J. Mark, Daniel C. Richenthal, and Jonathan Rebold are in charge of the prosecution, with the assistance of Special Assistant U.S. Attorney Alona S. Atlanta, Georgia, on misdemeanor charges is a matter of public record. The case is
pending before the State Court of Fulton County, Georgia. </span><span style="font-family: 'Times New Roman'; font-size: large;">Effective immediately, all legal matters filed with the United States District
Court for the Middle District of Alabama that are pending before Judge Fuller will
be reassigned to other judges in accordance with standard procedures for the
assignment of cases. No new legal matters will be assigned to Judge Fuller until
further notice. </span><br />

<strong>Washington, D.C.</strong> – House Judiciary Committee Chairman Bob Goodlatte (R-Va.) and Ranking Member John Conyers (D-Mich.) issued the following statement on the resignation of Middle District of Alabama Judge Mark Fuller, who was arrested in August 2014 for physically assaulting his wife in a hotel room in Atlanta, Georgia, a violation of state criminal law.<br />
<br />
“It is a rare occasion when the U.S. Congress impeaches a federal judge and removes the accused from the bench, but it is a necessary tool to protect the integrity of our judicial system.<br />
<br />
“However, the House Judiciary Committee was prepared to initiate impeachment proceedings against Judge Fuller pending the recommendation of the Judicial Conference of the United States, and the Committee strongly encouraged the courts to expedite the investigation into Judge Fuller’s misconduct.<br />
<br />
“When it became clear that the 11th Circuit would issue an order that Judge Fuller’s conduct could constitute grounds for impeachment, Judge Fuller decided to resign in shame. Once his resignation becomes effective, he will not qualify for either a judicial salary or be eligible for a judicial pension. If Judge Fuller does not resign on August 1st, as stated in his resignation letter, the House Judiciary Committee will consider whether impeachment is warranted once the Judicial Conference issues its final report.”<br />
<br />
<strong>Background:</strong> The Constitution gives the House of Representatives the power and responsibility to impeach federal judges and the Senate the power to remove the accused from office after a fair and impartial hearing.<br />
<br />
In December 2014, Chairman Goodlatte and Ranking Member Conyers sent a<a href="http://judiciary.house.gov/_cache/files/c3848ee0-5f4b-4500-9323-edb7bf0a76af/120114-carnes-tjoflat-letter.pdf" target="_blank"> <span style="color: #b77518;">letter</span> </a>to Chief Judge Ed Carnes and Judge Gerald Tjoflat of the United States Court of Appeals, Eleventh Circuit regarding the status of the investigation of Judge Fuller and the anticipated timeline for completion of the required comprehensive written report to the Circuit’s Judicial Council.<br />
<br />
The Judicial Council of the Eleventh Judicial Circuit has now concluded their investigation and issued an <a href="http://judiciary.house.gov/_cache/files/e666c5a6-f712-4bca-b20f-fdf6db14083e/fuller-order.pdf" style="color: #b77518; text-decoration: none;">order</a> that found Judge Fuller’s conduct ‘might constitute one or more grounds for impeachment under article II of the Constitution.’ This recommendation has been sent to the Judicial Conference of the United States which makes the final recommendation to Congress.</div>

<i>New York</i> ─ Chief Judge Jonathan Lippman today announced the appointment of Hon. Lawrence K. Marks to the position of Chief Administrative Judge of the New York State court system. The appointment, which will take effect on July 31, was made with the approval of the Administrative Board of the Courts. Judge Marks succeeds Hon. A. Gail Prudenti, who is leaving her position as Chief Administrative Judge to serve as Executive Director of the Center for Children, Families and the Law at Hofstra University’s School of Law.<br />
<br />
Chief Judge Lippman stated, “I am absolutely delighted that Judge Marks has agreed to serve as Chief Administrative Judge of the New York state courts. He is a highly accomplished judge and administrator who brings an array of talents and a wealth of institutional knowledge to this difficult assignment. Judge Marks has provided invaluable leadership as First Deputy Chief Administrative Judge since 2012 and over the course of an outstanding court career that spans more than two decades, helping implement crucial reforms to streamline court operations, enhance public access to the courts and trim case backlogs, among others. While I am heartened by the advances achieved during my tenure as Chief Judge to make the court system more efficient, accessible and transparent, more work remains toward ensuring equal justice for all New Yorkers and fostering public confidence in our justice system. Judge Marks is the best candidate to take on these enormous challenges. I have every confidence that his superb credentials, combined with his keen judgment, tireless work ethic and other fine attributes, will serve him well as we continue to make headway on so many critical issues, such as bail reform, juvenile justice reform and the elimination of New York’s justice gap, to name a few.”<br />

Judge Marks said, “I am honored that Chief Judge Lippman has asked me to serve as Chief Administrative Judge and assume the myriad responsibilities of this challenging position. <br />
Pursuant to Article VI, Section 28 of the New York State Constitution, the Chief Administrative Judge supervises the daily administration and operation of the Unified Court System, which has a budget of $2.5 billion, 3,600 state and locally paid judges, and 15,000 non- judicial employees in over 300 courthouses around the state. The Chief Administrative Judge is responsible for the performance, efficiency and productivity of every trial court in the state and works closely with the Chief Judge, Presiding Justices, Deputy Chief Administrative Judges and local administrative judges to review the performance of the courts, ensure the proper assignment of judges and court personnel, and implement policies and standards governing practice and procedure in the courts and the legal profession.<br />
<br />
Judge Marks has performed a key management, policy and legal role in the state court system for many years, having participated in the development and implementation of countless programmatic and legislative initiatives over that period. In 2012, he was appointed First Deputy Chief Administrative Judge, the second-ranking administrative official in the court system. In that role, he assisted the Chief Judge and the Chief Administrative Judge in all aspects of the administration and operation of the Unified Court System, working with courts throughout the state to develop programs and strategies to address case delays, enhance case processing efficiency and otherwise improve the administration of justice. He also supervised the court system’s Office of Policy and Planning, which oversees the state’s problem-solving and specialized courts.<br />
<br />
Prior to his appointment as First Deputy Chief Administrative Judge, he served from 2004 to 2011 as Administrative Director of the Office of Court Administration (OCA), responsible for day-to-day management of that office. He previously served from 1998 to 2003 as Special Counsel to the Chief Administrative Judge and from 1991 to 1997 as the OCA’s Deputy Counsel for Criminal Justice. Before joining the court system, he was a senior supervising attorney with the Legal Aid Society, in private practice and a law clerk to U.S. District Judge Thomas C. Platt.<br />
<br />
Judge Marks is the editor and co-author of a leading treatise on New York Criminal Procedure Law, and the author of numerous government reports and several law review articles. He has also been an adjunct professor at Brooklyn Law School and the John Jay College of Criminal Justice graduate program. He graduated, with honors, from the State University of New York at Albany and Cornell Law School, where he was also an editor of the law review.<br />
<br />
In 2009, he was appointed to the Court of Claims bench by then-Governor David Paterson; he was re-appointed to that position earlier this year by Governor Andrew Cuomo. Over the last several years, Judge Marks has handled an active caseload in the Commercial Division of the Supreme Court, New York County, and will continue to serve in that role along with his new duties as Chief Administrative Judge.<br />
<br />
Judge Marks added, “It has been a privilege for me to work closely with Chief Administrative Judge Prudenti over the past four years. The New York Judiciary owes her a great debt of gratitude for her tireless work on behalf of the court system and the citizens of this state. While she will be sorely missed in the courts, I know that she will be a tremendous asset in her new role at Hofstra University’s School of Law. Governor Hochul holds a bachelor’s degree from Syracuse University and a JD from Catholic University in Washington, DC. At the start of her legal career, she worked at a large firm in Washington and later as in-house counsel to a major corporation engaged in homeland security. Hochul then gave up private practice for public service. She was asked to serve as a legal counsel and legislative assistant to Congressman John LaFalce (D-NY) and later to Senator Daniel Patrick Moynihan.<br />

While the Appellate Division in Brooklyn affirmed the lower court's decisions on February 6, 2013 <i>(See the decision below)</i>, Scarpino's court is accused of secreting the fact that the estate in question was valued at more than a quarter billion dollars. One fact, though, was never in dispute. Scarpino and his troubled chief court clerk, Joseph M. Accetta, continues to preside over a corrupt death machine that allowed the Svenningsen Estate to linger, and generate unnecessary legal fees, for years- since John Svenningsen's death in 1997. </div>

Not to worry, though, "stonewaller" is probably the nicest name Anthony Scarpino has been called since becoming the lone Westchester Surrogate Court Judge in 2001. Scarpino ran for the Surrogate Judge spot touting his status as a former "special agent for the FBI," however it has been long-rumored that he pushed out of the FBI. Residents have wondered for years how the criminal acts of Westchester insiders have gone unaddressed by federal prosecutors. A clue may have come in October of 2012, when a federal grand jury in Salt Lake City indicted a former FBI agent, Robert Lustyik, from Westchester who used his position to derail criminal charges against a friend. In fairness, though, Scarpino is not alone- those loyal to him have received their own deserved criticism.</div>

Westchester Surrogate's Court Chief Clerk, Joseph M. Accetta, has been accused of being more sloppy than usual over the last few years as he's been battling a nasty divorce with his attorney-wife Susan Hegquist Accetta, of Stern Keiser & Panken, LLP in White Plains, in one neighboring courtroom (Index #7871/11)- all while fighting another nasty lawsuit as a defendant involving a neighbor in another courtroom (<i>Noah P. Kilduff v. Joseph Accetta, Index # 50176/11</i>).</div>

The misdeeds of Scarpino's criminal clan includes one favorite among Westchester insiders who chuckle at the concept of "conflicts of interest" in Westchester. An attorney-referee, Jody B. Keltz, and her attorney-husband, Carl T. In another case, Scarpino and Accetta were accused of accepting, filing and issuing court orders based on knowingly fraudulent back-dated documents to protect attorney Frank W. Streng of McCarthy Finger. Streng had been on Scarpino's election transition team, and the case involved the theft of over $100,000.00 of 9/11 Red Cross donation monies and insurance fraud. Scarpino, Streng and Accetta are accused of preventing the repayment of the stolen monies, choosing instead for the monies to go to lawyers. The icing on the cake, however, goes to Scarpino's involvement in the estate of Ice Cream magnate Tom Carvel, where over 20 attorneys were made millionaires on Carvel money. Cochran has been indicted for sexually assaulting a county employee for framing a woman who alleged that she had been sexually propositioned by Cochran and for tampering with a witness.</span></div>
<div style="margin-bottom: 9.1px;">
<span style="font-family: Georgia, Times New Roman, serif;">“Cochran is charged with crimes that reflect that he completely abused the power and trust given to him by the people of Murray County,” said United States Attorney Sally Quillian Yates. “First, he attempted to use his judicial position to solicit sexual favors from a female citizen. And, once the alleged misconduct came to light, Cochran tried to use his power and influence to cover up the incident by having the citizen framed for drug possession and by tampering with a witness.”</span></div>
<div style="margin-bottom: 9.1px;">
<span style="font-family: Georgia, Times New Roman, serif;">J. Britt Johnson, Special Agent in Charge, FBI Atlanta Field Office, stated, “This latest indictment brings to light additional details of an orchestrated scheme full of false allegations lodged against one citizen but, in the end, costing the careers and reputations of those public servants making them. The FBI will continue to work with its various law enforcement partners in investigating all matters regarding public corruption.”</span></div>

<span style="font-family: Georgia, Times New Roman, serif;">“It is important for citizens to have confidence in public officials, especially those entrusted with upholding and enforcing the law. The indictment of Cochran shows that people in these positions will be held accountable when they are involved in criminal activity. The GBI is committed to work with our federal partners to insure those in a position of trust are held accountable,” said Vernon Keenan, Director, the Georgia Bureau of Investigation.</span></div>
<div style="margin-bottom: 9.1px;">
<span style="font-family: Georgia, Times New Roman, serif;">According to United States Attorney Yates, the charges, and other information presented in court, from January 1, 2004 to August 15, 2012, Bryant Cochran served as the Chief Magistrate Judge in Murray County, Georgia. In that position, Cochran sexually assaulted a Murray County employee and unlawfully searched the personal cell phone of another Murray County employee.</span></div>
<div style="margin-bottom: 9.1px;">
<span style="font-family: Georgia, Times New Roman, serif;">In addition, on April 9, 2012, Cochran met with a female citizen regarding a legal matter. During the meeting, Cochran made inappropriate sexual advances towards the citizen. By mid-July 2012, the allegations of Cochran’s sexual misconduct towards the citizen had become public. In response, Cochran called several local police officers providing them with a “tip” that the citizen carried drugs in her vehicle.</span></div>
<div style="margin-bottom: 9.1px;">
<span style="font-family: Georgia, Times New Roman, serif;">In an effort to discredit the citizen, on or about August 12, 2012, Clifford J. Joyce (who was a tenant of Cochran’s and who has been convicted of conspiring to distribute a controlled substance) planted a metal tin containing five packets of methamphetamine under the fender of the citizen’s car.</span></div>
<div style="margin-bottom: 9.1px;">
<span style="font-family: Georgia, Times New Roman, serif;">Two days later, on August 14, 2012, Murray County Sheriff’s Office Deputy Joshua Greeson (who has since been convicted of witness tampering) conducted a traffic stop on a car occupied by the citizen. During the traffic stop, several officers and a police drug dog searched the car for approximately 15 to 20 minutes—but did not find any drugs. Thereafter, Captain Michael Henderson (who is Cochran’s cousin and who has also been convicted of witness tampering) had an approximately two minute telephone conversation with Cochran. Following that call, Henderson told an officer at the scene that according to his information; the citizen hid her drugs in a magnetic box under the left, rear tire well. Upon receiving that information, Greeson found the metal box magnetically attached to the car in that precise location. Inside the box, Greeson recovered five small packets containing methamphetamine. Greeson then told the citizen that he had recovered drugs from her car. At that point, the citizen stated that she had been set up. Despite this, Greeson arrested the citizen and transported her to jail.</span></div>
<div style="margin-bottom: 9.1px;">
<span style="font-family: Georgia, Times New Roman, serif;">On August 15, 2012, the day after the arrest, Cochran resigned his position as Murray County’s Chief Magistrate Judge. On August 22, 2012, Joyce admitted to law enforcement officers that he planted drugs—after which the local District Attorney dismissed the charges against the woman. Finally, in an apparent effort to cover up the framing of the woman, Cochran tried to persuade a witness to provide false information to law enforcement officers.</span></div>
<div style="margin-bottom: 9.1px;">
<span style="font-family: Georgia, Times New Roman, serif;">On May 13, 2014, a federal grand jury indicted Cochran, 44, of Chatsworth, Georgia, for: (1) conspiracy against rights; (2) deprivation of rights under color of law, (3) conspiracy to distribute a controlled substance, and (4) tampering with a witness. The most serious of the charges carries a maximum sentence of 20 years in prison and a fine of up to $250,000. In determining the actual sentence, the court will consider the United States Sentencing Guidelines, which are not binding but provide appropriate sentencing ranges for most offenders.</span></div>

The defendant is presumed innocent of the charges and it will be the government’s burden to prove the defendant’s guilt beyond a reasonable doubt at trial.</span></div>

<br /> The suggestion that <b><i>every</i></b> judge in New York State was trading their status as a judge to avoid legal responsibility was a thoughtless and desperate act by CJC Chief Counsel Robert Tembeckjian. The timing by Tembeckjian, himself under fire for selective enforcement of judicial ethics investigations, continues the accepted reality that the CJC wastes public funds and resources by pursuing issues not within the stated purpose of the CJC.<br /><br /> Did Mr. Tembeckjian just realize that a license plate identifying the driver as a judge just might give that judge a break by a cop? What about the reality that judges have accepted tickets from members of law enforcement and, in some cases, have had to nudge officers to actually issue a ticket. Every judge (and cop) knows that the public is watching events when a vehicle with "Judge's Plates" is engaged with a member of law enforcement. Some judges argue that they (or members of their family) have been denied the usual discretion of the ticket-issuing cop- whether to receive a warning in place of an actual summons- because of the always-hovering cloud of becoming mentioned in the next "ticket-fixing" scandal. One insider noted that Tembeckjian's improper over-reaching doesn't address the reality that most 'fixed' tickets are only fixed <b><i>after </i></b>they are issued.<br /><br /> Governor Cuomo should do New York a little favor and chime in on the corrupt people supposedly over-seeing the state's judges. The public, state employees, and judges deserve to have a competent- and ethical- committee involved with the state's judges. <br /><br /> Must the public endure another year of being disgraced by a so-called overseer of judicial ethics in New York State? Corrupt judges will go on their merry way knowing they are protected by the all-too-politial and corrupt group headed by Robert Tembeckjian.</div>

The New York Law Journal quotes a Bronx Supreme Court Justice, John Barone, as saying, “A lot of judges regard it as unconstitutional because it diminishes the compensation of a judge, and they have a good point.”</span></div>

The jumbled collection of vague numbers and words fills nearly 200 pages, and would surely be sufficient grounds to fire any accounting professional who would dare present such a "budget."</div>

The renovation of OCA's 30,000-square-foot Romanesque Revival landmark hotel-for-judges, a former convent, has been another waste, funded by creatively hidden budget entries. <b><u>Judges</u>:</b> here's a thankless group. Every judge is slapped with the reality that every decision he or she makes results in having made one temporary friend, and one permanent enemy. More outrageous is the fact that the court system was unable to give judges a raise for 13 years. And when they did get an insult of a raise, it was structured to be phased in over 3 years. There are a lot of court employees who have much to say about their decrease in pay, denial of over-time pay, and generally how mismanaged the entire court system is run. (<u>See</u>, <b><i>Shaw v. In addition, countless federal lawsuits have been filed against OCA regarding rampant corruption and the wide-spread practice of retaliation against anyone and everyone. It's the way the court system is operated in New York State.</div>

One such lawsuit is <i>Corrado v. New York State Unified Court System</i>, filed in the federal court in Brooklyn (EDNY # 12-1748) (<u>See</u>, <a href="http://www.justiceinourcourts.com/">www.JusticeInOurCourts.com</a>) After this state-employed ethics attorney was sexually harassed, OCA went into hyper-retaliation mode <b><i>against the victim</i></b>! Governor Cuomo has personal knowledge of this atrocity, and the federal court filing.</div>

Many years ago, a governor called Mario Cuomo was brave enough to support a Presiding Judge in Manhattan who was determined to confront the corruption within OCA's so-called attorney "ethics" department. The jury deliberated for less than an hour Wednesday before reaching a verdict that Lisa Margaret Smith committed battery against Julie L. Purcell on Aug. 20, 2006. The jury subsequently pronounced Mrs. Purcell was entitled to no damages for the act. "It was never about providing damages," said Stephen W. Gebo, Watertown, Mrs. Purcell's attorney. "It was particularly a vindication that she was the victim of a battery. The jury said she was, and we're pleased with that.<br /><br />Mrs. Purcell sued Ms. Smith in October 2006, claiming she was "sucker-punched" in the face at a gathering at a campfire. Mrs. Purcell was attempting to obtain more information about an incident the night before in which her two daughters and a friend had their clothes stolen and one of the girls was allegedly assaulted after skinny-dipping at Potter's Beach. Mrs. Purcell said she believed the judge's nephew might be able to identify some of the alleged assailants. Taking the witness stand Wednesday, Judge Smith, a chief U.S. magistrate judge for the U.S. District Court for the Southern District of New York, White Plains, vehemently denied she punched or kicked Mrs. Purcell.<br /><br />Judge Smith testified that she was temporarily blinded by the campfire as she approached Mrs. Purcell to ask her to stop "ranting" and using "vile" language in the presence of the judge's children and other children. Because she couldn't see, she had her hand in front of her as she walked. "I took two small steps, and I came into contact with something. I touched something," Judge Smith said. She said Mrs. Purcell immediately began screaming, "She hit me," an allegation the judge denied.<br /><br />"I did not touch her intentionally. I did not touch her maliciously," Judge Smith said. "I've certainly never punched anyone or hit anyone. I've never hit anyone. I don't even know how to punch someone." When asked by her attorney, Kevin E. Hulslander, why she immediately left the area while Mrs. Purcell was screaming that she had been hit, the judge said she knew it would be of no use to try to talk Mrs. Purcell about the incident. "I felt as though she had painted a target on my forehead and I knew that I was going to be in this courtroom, that she was going to sue me," Judge Smith testified. Mr. Hulslander said in his closing statement that the judge had been provoked by the "vile, nasty" language coming from Mrs. Purcell and that the judge was "standing up and taking a stand" on behalf of her children. He called Mrs. Purcell's lawsuit "revenge" for her belief she had been purposely punched, contending that Mrs. Purcell "exaggerated" the incident and her purported injuries. "Why are we here?" he asked the jurors. "Damages? Pain and suffering? This case? No. We're here because this woman here, Mrs. Purcell, wants retribution. She wants to bring a judge down."<br /><br />Mr. Gebo argued in his closing statement that Judge Smith "abused her position" by identifying herself as a judge before approaching Mrs. Purcell in an attempt to "intimidate" her. "I submit to you that punching Julie as hard as she could, when she wasn't looking, was malicious," Mr. Gebo told jurors. "This is an opportunity to say the law applies to every one of us, even a United States magistrate judge." The incident at Potter's Beach that led to the confrontation between the women is the subject of a separate lawsuit pending in state Supreme Court. That suit was brought by Mr. and Mrs. Purcell on behalf of their minor daughter, Maeve E. Purcell, and by their daughter Heather E. Henderson and a third woman, Lisa M. Lisa Margaret Smith, a chief U.S. magistrate judge for the U.S. District Court for the Southern District of New York, White Plains, was sued in October 2006 by Julie L. Purcell, James-ville, who claimed the judge "sucker punched" her in the face in August 2006. Kevin E. Hulslander, Syracuse, Judge Smith's attorney, argued in his opening statement that his client was provoked by "an explosion of expletives" from Mrs. Purcell in the presence of several children, including those of Judge Smith. "There's no doubt there was contact," Mr. Hulslander said. "There may have been a slap. The intent is what's at issue." According to court documents, the two women were discussing an incident that occurred the previous night in which two of Mrs. Purcell's daughters and a third teenager had their clothes stolen while swimming nude off Potter's Beach. One of the girls was allegedly assaulted as the teenagers tried to retrieve their clothes. The next night, Mrs. Purcell was discussing the incident around a campfire, with Mrs. Purcell claiming the judge's nephew had witnessed the incident at Potter's Beach and could identify some of the alleged assailants.<br /><br />Judge Smith denied the youth saw anything, prompting Mrs. Purcell to call her "a goddamned lying bitch," and asking her, "Why the cover-up?" according to Mrs. Purcell's testimony Monday. She said she heard "shuffling" coming from the area where Judge Smith was sitting and then "I was punched, full force, in the right cheek." She also claimed the judge kicked or kneed her. "She said, 'You're not going to call me a goddamned lying bitch. I'm a U.S. magistrate judge,'" Mrs. Purcell testified. Mr. Hulslander told the jury that Mrs. Purcell's outburst went beyond a single curse, stating that she directed numerous expletives at Judge Smith "around a campfire with children roasting marshmallows." "Judge Smith spoke up, said, 'I'm a judge, please don't swear in front of my children,'" Mr. Hulslander said.<br /><br />He contended that the statement initiated another round of expletives from Mrs. Purcell in which Mrs. Purcell indicated her indifference to Judge Smith's position. Judge Smith was charged by state police with second-degree harassment as a result of the incident. She later was granted a six-month adjournment in contemplation of dismissal and the charge was dismissed. Mrs. Purcell's attorney, Stephen W. Gebo, Watertown, denied his client swore multiple times, portraying her to the jury in his opening statement as an upset mother trying to find out more about her daughters' attack by "a mob" of eight people. Mrs. Purcell testified that she experienced pain in her cheek and around her eye for several months, although she suffered no permanent physical effect from the alleged punch. However, she said she remains "nervous" at times in public and the family has put its Grindstone Island property up for sale "because I don't feel comfortable there." She said she also had to leave her job as a grand jury court reporter. "I couldn't do that job any longer because I would start crying when I would hear these cases," she said. Her lawsuit seeks an unspecified amount in damages for the alleged effects the punch has had on her, as well as punitive damages. Testimony in the trial is scheduled to resume this morning.<br /><br />A separate lawsuit filed by the three girls who claimed they were harassed while skinny-dipping is pending. That suit was brought by Mrs. Purcell and her husband, Robert E., a Syracuse attorney, on behalf of their daughters, Maeve E. Purcell and Heather E. Henderson, and a third woman, Lisa M. Typically in a civil case, the side that prevails is entitled to recover costs incurred in the action, excluding attorneys' fees. But what happens when it cannot be said with certainty which side won or lost? Judge Joseph D. McGuire has ruled that, under these circumstances, "it would be inequitable to award costs to either party." The issue arose when a Supreme Court jury in Watertown ruled in December that Lisa Margaret Smith committed battery against Julie L. Purcell, but awarded no damages to Mrs. Purcell. Mrs. Purcell, Jamesville, had sued Ms. Smith, South Salem, in October 2006, claiming she was "sucker-punched" in the face by Ms. Smith at a gathering around a campfire on Aug. 20, 2006. She testified that as she walked toward Mrs. Purcell, she was temporarily blinded by the campfire. She said because she could not see, she had her hand raised out in front of her as she neared Mrs. Purcell and that her hand "came into contact with something," which Mrs. Purcell and others testified was Mrs. Purcell's face.<br /><br />A jury deliberated about 35 minutes before determining that Ms. Smith had committed battery, but awarded no monetary damage to Mrs. Purcell because she had not demonstrated that any pain or suffering resulted from the act. Ms. Smith, contending damages were an essential element of battery and their absence meant she won the case, filed a judgment Jan. 9 at the Jefferson County clerk's office against Mrs. Purcell for $1,095, representing her costs and disbursements in defending the case. The costs do not include attorneys' fees. According to an affidavit filed Monday at the clerk's office by her attorney, Kevin E. Hulsander, Syracuse, Ms. Smith "had to pay our firm tens of thousands of dollars to defend the case." Mrs. Purcell countered that she, not Ms. Smith, won the case and argued that she was the one entitled to costs because the jury had found that Ms. Smith committed battery. Mrs. Purcell applied to the court for an order vacating Ms. Smith's judgment.<br /><br />Judge McGuire ruled that an award of zero damages did not entitle Ms. Smith to costs or disbursements "when there has been a companion finding in (Mrs. Purcell's) favor arising out of the same facts." "In this case, both parties were successfully asserting their rights, although it cannot be said that there was complete success by either," Judge McGuire wrote in his decision. He granted Mrs. Purcell's motion to vacate Ms. Smith's judgment awarding her costs, but also denied a motion by Mrs. Purcell to have costs awarded in her favor. Judge McGuire's decision on the matter has been accepted for publication with the state Law Reporting Bureau, which serves as a legal reference for jurists and attorneys facing similar cases.
