While in no way excusing his actions, we have to believe that Judge David Gross believed that the system within which he acted as a judge was a thoroughly corrupt system with no oversight or accountability. So, he could do whatever he wanted, and always get away with it. This man was an active attorney and he saw other lawyers and judges getting away with everything.
The time has come for a massive change in New York's legal and judicial systems. Here's the sad story of former judge David Gross by Alfonso A. Castillo of Newsday:

Former Nassau County District Judge David Gross was sentenced Friday on federal charges that he conspired with an accused mobster to launder almost $400,000 in proceeds from stolen jewelry.
Gross, 45, pleaded guilty in July to money laundering conspiracy for his role in the scheme, which was uncovered by the FBI during an investigation into illegal gambling operations involving the Genovese and Gambino crime families.
Gross faced a maximum of 20 years in prison, but was sentenced to 33 months. He will turn himself in to federal authorities in January.
In court, Gross tearfully apologized to his family for letting them down.
Gross also agreed to surrender a 1999 Chrysler 300 automobile that he used to transport the laundered money, a pair of 1.7-carat diamond earrings given to him by an undercover federal agent, and $7,000 -- his cut from the scheme.
With his guilty plea, Gross also faces disbarment, federal prosecutors said.
Federal prosecutors say that in January 2005, while Gross was running for re-election, Genovese crime family member Nicholas Gruttadauria introduced Gross to an undercover FBI agent posing as a jewel thief.
Gross agreed to help the agent launder $130,000 in cash from stolen diamonds and watches through Cafe by the Sea, a Freeport restaurant, prosecutors said. He also agreed to help sell $280,000 worth of stolen jewelry, prosecutors said.
In a recorded conversation, Gross told the agent, "I know which rules not to break and I know how to get around everything else. ... You know, so cash is not a problem."
Gross served as a district court judge in Nassau from 1999 to 2005. During his one term, Gross built a reputation as an eccentric jurist – penning a book about his experiences on the bench entitled "If The Robe Fits," keeping a web site featuring his resume and legal decisions, and making headlines when a neighbor called the police when she caught him showering nude in his Long Beach backyard with his two young children. Gross liked to begin each day on the bench by saying, "Hi. I'm David Gross, and I'm your judge today."

He might get disbarred, but don't worry he'll get his law license back. I did. No biggie being a convicted felon of serious federal crimes in New York, if you know the right people.

I think they were all Felony convictions. They all got thier lic back. They have to pay to be lawyers I was told in N.Y.C i t was +/- 3,000 a year. The Disciplinary commmitee likes the money.

ReplyDeleteThis is unbelievable. Once again, these guys get away with their criminal activity for years and the damage they do is incalcuable. If they get caught, they still have reaped the benefits. They lose their license while the are in prision, but they wouldn't be able to run a very professional practice out of a cell anyway. Then they get out, and the organization that was supposed to protect us against them and didn't, gives them back their licenses, to do it all again. I seem to miss the logic here.
ReplyDeleteThe only one that I know of that never got his law license (and oh did he ever try) was Ted Friedman (husband of Queen Eve formerly of the NY Co. Surrogate's Ct). I believe Judge Judith Kaye even wrote at least one missive in support of Ted Friedman since her late husband was a boyhood chum of Ted.

They are getting bolder and more brazin- they must think they are unstoppable!

Remember...OCA really believes and acts as though it is the most powerful domain in AMERICA....even more so than WASHINGTON DC! This judge and his greed is one of many.... . and so many more know them...we need subpoenas for court employees with a guarantee of no retaliation....and GUESS WHAT YOU WILL FIND? The FBI knows this and they are the ones able to dimantle this corruption without waiting for overt corrupt actions by OCA! I am an ex-employee that they fired after 30 yrs for filing an action to investigate retaliation, discrimination and hostile environment, in the 8th judicial district! Oh what i found out, besides what i already knew...they forced a personal investigation! Many other employees would have come forward, except that the chief admin. judge in the th dist. SHARON TOWNSEND has threatened them to stay away from me or they will be fired...this is the chief judge talking...what is she afraid of? I assume she thought i would uncover her nasty mess, which i already knew, and influence other smart, stong employees who would then come forward with a hell of a lot more going on in her empire! I challenge all employees to come forward now...these corrupt judges cannot fire and terrorize everyone....bust them now!

ReplyDeleteI believe that the compalints are not anonymous, but the details of them are...to protect people from OCA trying to wire tap, create an accident or place harassing all dAY everyday phone calls to their personal home, while making a complaint in a higher court! The power OCA abuses is beyond anyone's comprehension, unless you are at the receiving end of their terrorizing retaliation. Making complaints about judges and the judicial system falls on DEAF EARS...more often than not. You are then left with fighting them off in all directions in your personal life and home! The judicial system is now beyond just reporting individual judges... A FEDERAL MONITOR must take control and sort out things through the process of safe reporting, using subpoenas and federal court action!

The reason for personality issues is the type of personality that desires to be in politics. So many people who crave the support of a group and one that exerts power, tend towards the very tempting need to participate in politics. They will argue with that assessment, but i have dealt with people from politics for years and find them to be so easily corrupted just to be accepted as they act like soldiers in the path of their party bosses! I believe many don't even realize their behavior is corruption, because they are not excepting funds for favors...corruption is about so much more. Taking a salary and not performing the minimum work required, taking multiple days and weeks off and not noting that on time sheets (exempt employees and judges) taking 2 hr lunch breaks and leaving work 1 hr early and coming late the same, everyday for multiple years...are examples of stealing tax dollars they receive as salary..are all forms of corruption! This why a monitor is necessary for the courts, because they are not targeted for this behavior in the news, as our city and county halls are. OCA gets away with daily blatant thievery because no one will address them, including the media...must be some stong fear OCA exertS towards PEOPLE OF THIS STATE!
