Tembeckjian Ignored Niagara County's Surrogate's Court "Criminal Enterprise"
Numerous complaints have been made to the Commission on Judicial Conduct concerning the judicial oddities and financial dealings in and about the Niagara County's Surrogate's Court. But the highly troubling affairs around the upstate Surrogate's Court appear to continue as usual, ignored by the 'ethics' group headed by Robert Tembeckjian. It appears that judicial ethics oversight has more to do with misplaced $20-dollar-bills by part-time village justices than the organized theft of millions by favored statewide insiders.
Question for Mr. Tembeckjian: Who told you to ignore the many complaints over the last five years against the Niagara County Surrogates?

— The attorney for Niagara County Treasurer David Broderick told a judge Friday that his client wants to continue to oversee an estate that has brought his office under intense scrutiny in recent months. Broderick’s attorney George Muscato told Niagara County Judge Matthew Murphy that he intends to file a formal objection by May 15 to a motion that would allow the son of the late Marian Snyder to assume control of the remainder of his mother’s estate. While during a previous court hearing on the matter, Muscato suggested Broderick might agree with such an arrangement, on Friday he told the judge he did not believe it would be appropriate for the court to remove Broderick at this time because the majority of the affairs in the Snyder matter had been settled. Murphy agreed to give Muscato until the court-imposed deadline for filing the necessary paperwork but indicated that he is inclined to allow Snyder’s son, John “Jack” Snyder, to oversee his mother’s estate in the future. “By making the determination I’m not pre-judging any claims about Mr. Broderick’s handling of the estate,” Murphy said.
Under the law, the Niagara County treasurer as the county’s top fiscal officer is designated as the public administrator of estates. Snyder’s daughter, Amherst attorney Teresa Snyder, has filed several objections against Broderick in the handling of her mother’s affairs. Snyder maintains Broderick violated state law governing the duties of public administrators by allowing his wife, Jane, to serve as the real estate agent on several properties under his care, including the Snyder family home in Lewiston. Teresa Snyder has strongly objected to what she says was an attempt on the Brodericks’ park to sell her mother’s home to one of their relatives. State court rules designed to insulate the offices of public administrators from the appearance of any impropriety bar anyone serving in that capacity from self-dealing and from hiring their relatives as outside vendors. In addition to her objections in court, Teresa Snyder also has sent letters to the attorney for the state Office of Court Administration and the Office of Inspector General, encouraging officials to investigate Broderick’s public administrator work. Earlier this month, Murphy and fellow county Judge Sara Sheldon Sperrazza sent a letter to the state Comptroller’s Office requesting an audit. The Niagara County Legislature has endorsed their decision. Muscato has denied all charges of wrongdoing against his client, insisting that he has done nothing unethical or illegal in his capacity as public administrator. On Friday, Teresa Snyder also submitted objections to the court for the amount of legal fees charged to her mother’s estate by Muscato and three other attorneys involved in the case. Murphy has scheduled an August hearing for the remaining unresolved matters in the case. On Friday, he offered to work with both sides in an effort to reach some sort of settlement. The Snyders and Muscato indicated they would be willing to participate in a future settlement hearing. An Amherst attorney who raised questions about the conduct of Niagara County Treasurer David Broderick agreed on Friday to drop all claims she made in her family’s case after a judge said he was inclined to allow her brother to handle the remainder of her late mother’s affairs. Teresa Snyder, who has accused Broderick of overstepping his bounds as public administrator, told Judge Matthew Murphy she would withdraw her petition to have Broderick removed as the administrator of her mother’s estate if the court appointed her brother — John “Jack” Snyder — to oversee the distribution of all remaining assets. During a hearing in surrogate’s court in Lockport, Murphy announced his intention to turn the responsibilities of the estate over to Snyder’s brother, one of five siblings involved in the case. Broderick’s attorney, George Muscato, said his client would be open to such an arrangement. “I think Mr. Broderick will consent,” Muscato said
In light of the new agreement, Teresa Snyder told Murphy she planned to discontinue other actions not directly related to her mother’s estate, including requests made to outside agencies for investigations into Broderick’s conduct. Snyder has suggested that Broderick violated state law governing the duties of public administrators by allowing his wife, Jane, to serve as the real estate agent on several properties under his care, including the Snyder family home in Lewiston. Last week, Snyder sent letters to the attorney for the state Office of Court Administration and the Office of Inspector General, encouraging officials from both agencies to take a closer look at least three cases in which David Broderick was appointed as public administrator by his brother, retired Judge Peter Broderick, and a third brother, Niagara Falls attorney William Broderick, served as the administrator’s lawyer. Public administrators oversee estates in which the owners have died without leaving wills or the heirs are unable or unwilling to tend the affairs themselves. State court rules designed to insulate the offices of public administrators from the appearance of any impropriety bar anyone serving in that capacity from self-dealing and from hiring their relatives as outside vendors. Under the law, the Niagara County treasurer as the county’s top fiscal officer is designated as the public administrator of estates. Following Friday’s court proceeding, Snyder said it will now be up to the various oversight agencies to determine if any wrongdoing occurred. She added that as a practicing attorney she felt obligated to adhere to the rules of professional responsibility and report what she found during the course of her research. “Conflicts of interest should not occur and they did,” she said. Her brother agreed. “I believe that the use of (Broderick’s) wife is self dealing,” he said. David Broderick and Peter Broderick could not be reached for comment.
Muscato has dismissed Snyder’s claims and insists his client has done nothing illegal or unethical in his capacity as public administrator. When asked about allegations concerning the Broderick brothers, Muscato said his knowledge of surrogate’s court cases involving his client was limited only to the Snyder matter. “This is not about any other estates,” Muscato said. “It’s about only this estate.” Reached by telephone Friday afternoon, William Broderick said he did not recall any instances in which he appeared before his brother Peter on estate cases or any other matters. He indicated that any dealings he had in surrogate’s court were assigned to other judges. “It was my recollection that I never appeared before my brother Peter on anything,” he said. Earlier this month, Murphy and fellow county Judge Sara Sheldon Sperrazza sent a letter to the state Comptroller’s Office requesting an audit of Broderick’s work as public administrator. The Niagara County Legislature has endorsed their decision. On Friday, Murphy indicated he did not believe county surrogate’s court was the proper venue to address any outside claims and said he intended to rule only on matters related to the Snyder case. “Surrogate’s court is a court of limited jurisdiction,” Murphy said.
Before hearing arguments in the case, Murphy addressed what he called a “complaint” about his handling of the Snyder matter that he said Teresa Snyder filed against him with the New York State Commission on Judicial Conduct. Murphy said he did consider recusing himself from the Snyder case, but, after conferring with colleagues, determined that it was best for him to continue as the presiding judge. Murphy said he held no ill will against Snyder or anyone else in the case. “I believe I can be fair to all the parties in this matter,” Murphy said. After the hearing, Snyder denied ever making a formal complaint about Murphy to the commission, although she indicated that she did have some interaction with the agency which oversees the conduct of judges across the state. Snyder added that the commission’s dealings were confidential before declining further comment. Next up in the Snyder case will be a formal review of the accounting of the estate filed by Broderick. The treasurer has requested more than $15,000 in commission for his work on the estate. Muscato indicated that his client has no intention of withdrawing his claim and said he believes Broderick is entitled to the money. Murphy set aside three days in August to hear arguments from both sides before he renders a decision on the appropriateness of the fee. John Snyder he has not yet decided whether to contest Broderick’s fee and would discuss the matter with his siblings before making a determination.

ReplyDeleteI pray that Mr. Tembeckjian and Alan Friedberg are squirming like the worms that they are. They have totally screwed countless people who had trust in the Niagara County Surrogate's court.
These worms will be answering questions, to be sure. I can only hope that they are answering these questions very soon in a public state or federal criminal court proceeding.
The bigger question concerns whether Tembeckjian's head is up Friedberg's aars or if Alan's fat head is up Bob's rump. Or both. This is my big question.

For Alan and Bob's sake, I hope they never have to answer real questions under oath. They've only been doing what they have been told to do. They quickly bought into the whitewashing and though they didn't know what they were getting into originally, they happily have gone along for a long, long time. And they have profited nicely.

I had a right to a formal accounting, those only cost 1,000 - 1500- why did CJC dismiss this complaint, why did the FBI tell me to have the State Attorney General investigate these attorneys and why did the State Attorney General refuse to properly investigate?
this would be the 4th case in the 8 and it proves what I have been stating all along, someone is intentionally trying to deny me every single right I have including human rights!

The ex-Administrative Judge of the 8th district..Sharon Townsend....was suppressing, influencing and lying about all complaints that were directed against the court system....and participating in illegal actions to bury the dirt.
ReplyDeleteI would venture to guess that her stepping down a few weeks ago in conjunction with Jan Plumadore...was a statement that things that involved them both were getting too hot ...so Plumadore went and hid in a court that keeps him out of the way..and Townsend remains sorta, as a Supreme Court Judge in Buffalo..but her duties have her hiding wherever the Judicial college is...where they claim she is teaching?
Hmmmm...Niagara county issues were of close concern to Townsend and whatever anyone has endured from their illegalities and abuse of power...directly goes to Townsend and her boss tweed Plumadore...they are the culprits in all of the misdeeds from 2003-to present. They also took over anything crooked that was influenced from NYC headquarters from around 2000....when the OCA invasion really took hold in the 8th.
There mission from Kaye for their appointment was to establish corruption upstate and downstate would block any resistence with firings of employees that got in the way, dis-barring attys who pointed to them as criminals and assurance that massive family groups with political backing would be absorbed into the courthouses in positions as operatives of OCA participating in spying,wiretapping, auto damaging, false arrests, slander and defamation of character and reputation of the most innocent.... who got in their way. Organized crime at it;s purist.
This is a simplification of what is going on upstate...the real quantity of the judicial sins are left to the federal investigators to expose and for the media to finally inform the public, who will be grossly appalled at a judicial system that was in place to apply the law to only those that were.... non-judical criminals.
The real crime activities are in place without obstruction...to enhance and create tremendous powerful judicial careers for weak, mediocre and cowardly political lawyers!

Sounds like a familiar theme and story in hudson valley region where town and village court justices, usually not lawyers, get hammered by the cjc when often having virtually no clerk, budget, resources, etc or minimal and yet larger injustices at county, family, supreme level went unchecked entirely. ny times did article around 2006-2007 on cjc and local courts and ny post did article on upstate judge who had all complaints whitewashed. horrible story from dutchess county too involving Mother of the Year Russian native milked as cash cow, jailed while pregnant and worse for years in matrimonial court and family court. 2 page spread on that one by brad hamilton at ny post from 2005.

ReplyDeleteThe Surrogate's Court in Dutchess is just as bad, Bernstein is an enforcer for Judge Pagones. We have heard about the Judge Czajka up in Columbia and its nothing good. They are all bums. We complained about Judge Pagones and we never heard anything and they screwed us all the more.

Surrogate Weiner was the Judge that destroyed me and then became a Surpreme Court Judge. Investigate Rockland Co., NOW! I bitched to everyone and was told to shutup if I knew what was good for me, if you know what I mean! They cover for each other, its like the mob!

Let's not forget Orange County where Judges, attorneys and law guardians are having a ball. Stealing, cheating, altering transcript, falsifying court orders, having secret meetings, tampering with court records, steering cases. Go ask Ex Judge Lawrence Horowits and ex Judge Alexandro. Before Judge John K. McGuirk steps down, I strongly believe he is the puppet master. I just hope when he does steps down Paterson has the common sense to pick a judge who is going to follow the law regardless of your social status and racial origin.
ReplyDeleteManhattan has 2 Surrogates because one can't handle all the payoffs. I was told that my hunband's estate would never close unless I did what the Judge want. I talked to other people at the court and they told me the same story. Ha, and one of their lawyers told them not to say anything to me. When I finally left that HELL HOLE I felt like I was mugged.

ReplyDeleteAttorneys in NY are allowed to steal, lie, commit crimes and act in any despicable way they want, and for the most part are never charged with a crime, go to jail or have the privilege of practicing law in this state taken away either at all or for any significant length of time.
Judges are allowed to preside over any court the Administrative judge feels like assigning them for as long as she wants. (Although she herself is an "Acting" judge and has in many cases taken away the constitutional requirement that judges in this state be elected)
The attorney disciplinary committees are run by attorneys who don't have to tell anyone what they do.
The judicial ethics committees are run by judges who don't have to tell anyone what they do.
The OCA does what it wants and doesn't have to tell anyone what they do.
The AG of NYS ignores complaints made to his office about the illegal acts of attorneys, judges and state employees.
The judges of NYS don't like the pay they are getting for the jobs that they have spent considerable time, effort and money obtaining, so they get one of their friends on the bench to preside over their lawsuit, to give themselves raises.
NYS is now being run by a governor who was not elected to the position, who has appointed a friend to the position of lieutenant governor and state comptroller is also currently appointed.
NYS lost an elected senator to the US Senate, and has an appointed one.
President Obama has interfered in the NYS politics by following Schumer's advice to prevent other qualified candidate from seeking the position.
Charles Rangel is guilty of tax evasion and other state and federal crimes.
Ex-governor Spitzer got off with no criminal charges.
Calls to the FBI and other government agencies have been continually ignored.
I guess this list could go on, but I'm getting overwhelmed at it all.
Is there anyone who has been keeping track of these characters?
I'm thinking I wold have preferred to be back in the days of Boss Tweed. I don't think he has anything over these guys.
At least back then, the Federal government may not have been a willing participant in the goings on of this state. But they certainly are now.
Anyone have a suggestion of another state to move to (or maybe another country)?

To 6:03 PM Maybe the Daily News will replace Tmbeckjian's wife as legal issues reporter. Their ox will be gored and then what will they do? The media is responsible for this corruption, but when will they wise up? It's the little boy and the emperor; at one point it will become undeniable. Stick it to them Frank.

ReplyDeleteI bitched about the Bklyn Surrogate and got no where personally. Something that was simple was made complex so that the members of the club would profit. The Judge was finally removed but what good did that do me. The Judge should have been made to pay back all his victims and put him in the poor house.

Filed complaints about 2 Judges in our cases without our lawyers knowledge. When they found out what we had done they abandon us and told us that they were in trouble with the Judges. The CJC gave us lip service.

ReplyDeleteOne of the Manhattan Surrogates covered up a felony. She said in D&O that even if criminal events transpired it was not her job. A large white shoe firm was in the middle of the cover up. Was told that the firm wrote the D&O for her. It was for an accounting matter. The papers were send to the US Attorneys Office and taken in under crimianl, but heard nothing. Do the big law firms get a free pass and cover ups go on like Madoff till they blow up.

I often wondered why my filed grievance against Surrogate Pagones and the people in his court never went anywhere, now I know! The purpose of the regulatory agencies is to protect these clowns! How nice, well at least now there in no pretense! And I'm not alone! I wonder how many more victims are out there?
