Judge: County jurists might have too much power

HARRISBURG, Pa. - A judge leading efforts to rebuild the system of juvenile justice in Luzerne County in the wake of the "kids for cash" corruption scandal said Wednesday that the state courts may be giving county supervisory judges too much unchecked power. Luzerne County President Judge Chester Muroski told the first public hearing of the 11-member Interbranch Commission on Juvenile Justice that he hopes state rules will be changed to give all judges in a given county more input into decisions. Muroski's two predecessors as his county's top judge, Mark Ciavarella Jr. and Michael Conahan, are facing federal charges that accuse them of taking kickbacks to place juvenile defendants in private youth detention centers. The commission was established by the Legislature, governor and state Supreme Court in August to examine the causes of the Luzerne County juvenile court scandal and to recommend changes to prevent it from recurring. "Simply put, it is my opinion that the absolute authority of the president judge over court affairs, and the abuse of power regarding same, coupled with the improper conduct of another judge, have been the principal causes of the scandal," Muroski said. President judges are elected by their fellow judges to serve as the top administrative officials for their counties' court systems.

"What happens now, it's all based upon who's running the show," Muroski said. Many of the actions Ciavarella and Conahan are alleged to have taken so they could profit personally occurred while each was serving as president judge, prosecutors have said. Ciavarella and Conahan held very few meetings of the county judges as a group and their decisions about where and how to place juveniles went unchecked by state and county officials. There were enough rumors swirling around the courthouse, however, that Muroski contacted the FBI in 2006 with his concerns. Muroski said there was wide support within his community, particularly among school officials and police officers, for Ciavarella's efforts to crack down on juvenile offenders. He said a 2004 series in the Wilkes-Barre Times Leader about Ciavarella's sentencing patterns was a rare example of questions being raised about those practices before the judges were indicted in January, but that it "did not have legs" and Ciavarella won a retention election the next year. "The sound that resonated loudly from Ciavarella's courtroom was his no-nonsense, zero-tolerance approach, particularly in school cases," Muroski said. The commission also heard testimony Wednesday from House Majority Leader Todd Eachus, D-Luzerne, and state Sen. Lisa Baker, R-Luzerne, as well as experts in juvenile criminal procedure and attorney ethics. Superior Court Judge John M. Cleland, who chairs the commission, said it was self-evident that Luzerne's president judges exercised their authority improperly. "Whether that exists in other counties is something we're going to have to look at," Cleland said. The commission plans hearings in Luzerne County next month and must issue a report with recommendations by the end of May.

    The big joke is that OCA made it look like Nicolai was stepping down when, in fact, they moved him over to another supervisory position. Pfau and Lippman lost ALL credibility with that birdbrain move. And why does Nicolai still get a driver to move his fat rump all around town like he's some person deserving of respect. Nicolai belongs in jail.

The 8th judicial district did the same thing with the very controversial and corrupt Sharon Townsend...they moved her main job to the center of the state...training other judges relative to the family court system...bless those who have to learn from this crook....but kept her status as judge in the 8th.

    Townsend also had a driver for several years... as she may have started the trend since she knew she screwed people that had long time integrity with the system...by terminating their job with fake misconduct documents and perjury....which should eventually secure her job loss, knowing that employment was the only source of their income, then viciously destroying their reputation and demanding that all court employees cease contact with said employee.

    Her reign as queen of the district was shaky with most of the insiders, so by stepping down she attempted to avoid the continuous disgust of her in that position....so to give her credibility OCA sent her packing to the middle of the state to the judicial college, while keeping her position as a supreme court judge here....while assigning her as the sole individual capable of training future judicial family court judges in the methods she has employed for years as an undesirable lawyer as well as judge and administrator/supervisor.

    So..yes Lippman and Phau are using the switch and bail method, while claiming to cleanup their filthy house. So don't be surprised that they continue this process and offer vehicles for their co-operation.

  11. one case alone coming out of the Columbia County Family Court in the Hudson Valley region close to Albany has had 2 sons "locked" in the State Foster Care system for 9 years while being administered harmful anti-psychotics like Risperdal which has been shown to cause severe growth defects ( large breasts in boys ) and be related to premature deaths in teens. the drugs have been administered against the consent and will of the parent while Original Records to THIS DAY have been COVERED UP in the State system and where the current Chief Attorney of the Third Department Appellate Division "Standards Committee" has whitewashed complaints including one against a lawyer who took $10,000 ( ten - thousand ) in the case from the elderly parents of the father promising a Trial for the father that would never occur. the lawyer has never provided an Accounting of how the $10,000 was used and the "trial" never occurred and the Chief "Standards" lawyer has whitewashed the complaint seeking an accounting and more where BASIC Documents have been DELIBERATELY kept out of the proceedings including an Expert Psychological Report from Oct 2000 claiming the Family should begin Reuniting back then or face permanent psychological harm and more. This one case alone now touches the County Judge in Columbia County, the Supervising Matrimonial and Family Court Judge of the Third Dept named Gerard Maney who has committed direct fraud and more in the case and the fraud has been covered up thus far by the Third Dept Appellate Division itself that has literally "fabricated" claims in the phony decisions rendered thus far. Time to let the Hounds do their job!!

    Townsend's husband is a crook to..used to talk to him a lot in the early 80's when he was a new face...she never knew that or did she...and that is her vendetta. Diva's hate competition that happens behind their backs and learn of it later...many years later.
    Very cute and very tall man....can't understand her antics with others! Can't really understand the men that are interested in her..or maybe I do, but find it gross....Maziarz is one of them...football head?

    What is up at ECMC...know some Drs. there...those hospital soaps....they are not juicier than what I saw at the courthouse for years....sex in the stairways ,offices, handicap bathrooms(the space is larger) and the judges' chambers and court benches...be careful not to touch a judge's bench..... this is better than the courthouses....really? Give it up..ok?

    Did you know that when a Judge breaks the rules... it's the litigants fault... irrespective of the fact that the litigant was represented by a self dealing attorney who refused to represent the clients interests....

    So long as you have a conspiring attorney, who allows the Judge to break the rules, you waived your right to due process... regardless of the fact that the rules were not subject to a waiver in the first place....

    A beautiful scam... if one were to believe it....
