Feds Closer to Kerik's Outing of Westchester and Manhattan DA Corruption

At 11:15 am on October 30, 2009, we posted "Kerik Offered 'Get out of Jail' Card" that advised that a knowledgeable source had advised that former NYPD Commissioner Bernard Kerik had been offered a deal of a lifetime- that he could walk out of jail, and that all pending criminal charges against him would be dropped for his complete cooperation and testimony involving widespread public corruption in New York. While we note the New York Daily News story below, dated November 3, 2009, we stand by our original information. We have been further informed that the 3-year deal was a counter-offer. The original deal to Kerik stands: "Talk and Walk." Informed sources believe, firmly, that Bernie can blow the lid off corruption in New York, and specifically inside the Westchester and Manhattan District Attorneys' offices involving former Westchester DA Jeannine Pirro and the recent criminal prosecution of Brooke Astor's son, Robert Marshall. Three for the price of one: Kerik offered deal of less than 36 months jail for impending cases

On the eve of his corruption trial ex-NYPD top cop Bernard Kerik was offered a plea deal that would get him out of jail in under three years, the Daily News has learned. Kerik faces three federal trials, the first on charges he got $255,000 in apartment renovations from a mob-linked contractor seeking a city permit. The second trial, also in White Plains, involves charges of hiding more than $300,000 book fees, royalties and free rent from the IRS. A third case filed in Washington federal court charges the former NYPD commissioner with making false statements on his application when President George W. Bush tapped him to be Homeland Secretary. Under the proposed deal, the cases would be consolidated and Kerik would face a possible sentence of 27 to 33 months, a source familiar with the ongoing talks said. Kerik could be sentenced to 20 years if convicted.

As of yesterday, Kerik had not formally accepted the offer and could, in the end, decide to go forward with the first of three criminal trials starting next Monday in White Plains Federal Court. Defense lawyer Barry Berke did not return calls seeking comment. A spokesman for Manhattan U.S. Attorney Preet Bharara declined to comment. The deal would let Kerik plead to lesser charges in the corruption case, sources said. He would only have to admit to conspiracy to deprive the city of honest services. In turn, the feds would drop mail and wire fraud charges which carry potential five-year sentences, the source said. The former appointee of Mayor Rudy Giuliani would also have to plead guilty to some charges in the tax evasion case, as well as admit to filing false statements. Pressure has mounted on Kerik to resolve his outstanding legal issues since Oct. 20, when prosecutors claimed Kerik was involved in trying to sway potential jurors on the eve of his trial. White Plains Federal Judge Stephen Robinson threw him into the Westchester County jail. He was segregated from other inmates because of his law enforcement background. Two days after he arrived he was placed in the psychiatric unit after displaying certain unspecified "symptoms" in lockup. A letter from Dr. Robert Mahler released yesterday said Kerik was placed there "for observational purposes and psychiatric assessment in the context of psychosocial stressors." Kerik was discharged from the unit after doctors determined he "poses no risk to himself or others due to any psychiatric illness." Kerik is charged with getting a mob-linked contractor to pay for $255,000 in renovations to his apartment. At the time, the contractor was seeking a city permit. Kerik, then the city's corrections commissioner, vouched for the contractor, prosecutors say. rgearty@nydailynews.com

    A lot of games are played with the hand-picking of criminal cases. Criminals with friends in high places get away with everything. And while it's very political in Morganthau's office, where some high level people are involved, it's much worse in Westchester. The criminal cover-ups, and retalitory thuggery goes all the way to the top in Westchester. Currently, with DiFiore, and previously with the Queen of corruption, Ms. Pirro. And, in Westchester, it involves a lot of judges too.

  5. Someone just walked up to me and out of the blue said...thank god for 'expose corrupt courts'. I asked do you go on this site much and he said no...but thank god for expose corrupt courts!
    So Frank Brady...you are reaching people out of the loop who are thankful for your reporting of an issue that gets no media time or attention..but is of great concern to NY citizens throughout this state...if OCA et al....only knew the masses this is reaching and empowering everyday and every year!

    Congratulations for bringing this entity and their criminals to exposure...it is working, even though it takes time...could bust out at any moment...you never know when a "Clarence Thomas' will come along during this internet age.

  6. I always thought that criminally prosecuting Brooke Astor's son was wrong. Hell, you could indict every relative of every person who ever died. The push to take control was made through lawyers (prosecutors) by lawyers for the trust and estate bar. And, of course, the corrupt surrogate courts like in Westchester, Rockland, the Bronx and Manhattan. It's ALWAYS about lawyers getting legal fees. That's it!

  10. I have FIVE new heroes in my life. THE HONORABLE Shira Scheindlin, the indelible Maxwell Smart aka Frank Brady aka Kevin McKeown aka FrankEbaby, Christine C. Anderson and Lovett and Bellantoni!!! All of them are Heroes for bringing the criminal elements of Anderson out at both the NY Senate Judiciary Committee Hearings and in a Federal Court before a Federal Judge, no turning back from that Jack. The number of officials now directly exposed to these crimes has increased in mass, to Scheindlin, the US Attorney, the DA and First Department. All now have LEGAL AND BINDING obligations, now let’s see who vacates those duties and who follows them and begins criminal and internal affair investigations. Those that do nothing will have fingerprinted themselves, those who do their duties will rise quickly in stature.
    Gotta feeling I will be driving Scheindlin to the Supreme Court one day, picking up Brady to take him to his job as Chief Ball Buster of corrupt Judges and attorneys as the FBI Director and as for Christine, Mother Teresa is probably getting old. Certainly, she should be First Dept Chairman. Catherine Wolfe, we shall wait to see if she is angelic or demonic with the rest, like I said, she did me a solid with the other heroes that I will never forget. To all those fighting the good fight and showing courage under fire, g-d bless, you may strike fear in the heart of evil and strike goodness in the hearts of the PEOPLE that they can make a difference.
    So my hat off to those who have brought us this far and farther than I ever imagined. Whitewashing of complaints for US Attorneys, DA's and ADA's by the "Cleaner" come on, top that. Fire in the Hole for the Mountain is aflame!
    All who witnessed Anderson's testimony should be writing letters to all those named and demanding justice and to all those with oversight responsibilities. As the jury did not ascertain or review any of the CRIMINAL allegations their dismissal of three morons did nothing to change or harm the related cases.
    As for Anderson's attorneys, again, two more heroes, thanks for getting that Criminal info out in a civil case with no fifth amend plea and certainly Anderson could not have gone to criminal authorities since she was naming them all and so the civil court was a perfect way to get it out and put the onerous to cover up now all the way at the top. If Lovett and Bellantoni need a client case worth a possible trillion, well you know my name, my number is 561-245-8588 (o) or 561-886-7628 (c) and hell if we win that, Christine on the reach around will be the richest Mother Teresa of all time.

Look for Bernie to be walking free within the next week or so...... we just may not know about it..... the trial will quietly postponed, and he'll be in hiding..... but, he will have talked and he will have a need to be in hiding and that's a very good thing.     I have to tell my US Attorney I was not in the psych ward and I do not hear voices.......

  18. I was informed today that my earlier comment regarding my five new heroes was somehow not well intended. I meant every word I said, including that Frank or Kevin or whoever has done me a strong solid so far and it took a lot of hard work and people willing to committ their lives and testimony regarding these crimes.

    All of this has already helped me personally and I owe a lot to Frank and Christine already and would give my life for them at this time. Until someone can prove they have done me wrong, I really don't care who or what Frank or the rest is all about. I mean I care but that will come out in the end and for what they have done, again my heart and hat to them.

  21. What did Cuomo know and when did he know it? Don't let Cuomo off with his monkey business of: see no evil; hear no evil in the NY courts and lawyers. Cuomo's monkeys do evil when they cover up the lawyer and judge crimes. Cuomo, prosecute Lippman and Ramos, now.
