Lippman's Failed Attempt to Explain Corrupt Waste of Money

New York State Chief Judge Jonathan Lippman’s Statement on Proposed 2010-11 Judiciary Budget

I must respond to the Governor's commentary on the judiciary’s fiscal year 2010-11 proposed budget, in which he asks that I revisit the judiciary's request and offers suggestions for how it may be reduced. The commentary states that the judiciary must do more to “restructure” its operations in light of the State’s economic downturn, and suggests that its budget request should be dramatically reduced, by as much as $132 million. The commentary reflects both a misunderstanding of the judiciary’s basic constitutional obligation to hear each and every case that comes before it and a failure to appreciate fundamental differences in the budgets of the Judicial and Executive Branches. The Governor's commentary completely ignores the fact that this is a no-growth budget request. Even though the court system’s workload has reached historic levels, the request seeks not a single dollar for enhanced court operations. The additional funding sought essentially represents extraordinary, non-discretionary cost increases beyond the judiciary’s control, including $84.6 million in contributions to the State’s pension fund, $58.4 million for nonjudicial salary increases required by collective bargaining agreements and $7.5 million needed to cover mandatory increases in health insurance and other fringe benefit costs. Suggesting that the judiciary should consider reducing its budget request by as much as $132 million, the Governor presumes that the court system can absorb these extraordinary mandatory costs. Unlike Executive Branch agencies, however, the judiciary cannot simply eliminate costly programs or defer expensive capital projects. The judiciary does not operate “programs” – it adjudicates cases. Indeed, the overwhelming portion of the judiciary’s budget – nearly 90 percent – is personnel costs. Savings of the magnitude suggested in the commentary would require the elimination, mainly through layoffs, of approximately 2,000 court employees. This would have a devastating and irreparable impact on the courts’ ability to perform their constitutional role at a time when caseloads are spiraling and the public’s use of the courts has multiplied because of the economic downturn. Judges’ ability to monitor drug offenders’ participation in treatment programs, to resolve foreclosure matters in settlement conferences and to conduct countless other proceedings on which the Governor’s own initiatives depend, would be drastically compromised.

The Governor singles out three items in the budget request that “result in increased costs.” First, the request seeks an increase in judicial salaries, at an annual cost of $48 million. A judicial salary increase, however, has been sought in the judiciary’s last several budget requests, and therefore the current request does not represent an increase in costs over last year’s request. In any event, the painful and inconceivable fact is that New York’s judges have not had a single cost-of-living increase in over 11 years, and I make no excuses whatsoever for addressing that travesty in this year’s budget request. Second, the request seeks an additional $6 million to increase the Judicial Supplemental Support Fund to $10,000. For judges who have gone so long without a single raise, this modest increase – representing less than one-quarter of one percent of the overall judiciary budget request – is wholly justified and, I must say, the very least we can do for a judiciary that meets it constitutional responsibilities each and every day under the most difficult circumstances. Third, the request seeks $15 million for civil legal services. As I noted in recent legislative hearings on this subject, no issue is more fundamental to the court system’s mission than ensuring equal justice for all. This amount will offset the precipitous shortfall in IOLA revenues, and will help in our most vulnerable citizens in their time of greatest need. For several years, the judiciary has been keenly aware of and responsive to the State’s fiscal crisis. As a result, we submitted a zero-increase budget request last year, we eliminated several hundred positions in the courts during the current fiscal year and we are well into our second year of a strict hiring freeze for administrative positions. In those respects we have been ahead of the Executive Branch. The judiciary remains committed to working with the Executive and Legislative Branches to address the serious challenges confronting our State.

Time for Lippman and Pfau to put their money request's quote, Lippman: "...no issue is more fundamental to the court system’s mission than ensuring equal justice for all." where their mouths are. I've written to Judge Pfau and Judge Lippman concerning my complaints against Acting Judge Kevin K. Ryan copied from earlier comment because same complaint was made to Lippman and Pfau: Lippman and Pfau, you have been personally informed of the corruption of Judge Kevin K. Ryan, who moved up a two week later scheduled court date to later that same day's morning while I was in cardiac intensive care and the NOTICE to me was a call that same morning by the judge's staff to the hospital. You know the FACTS that the hospital doesn't accept calls into cardiac intensive care and Judge Ryan refused to rehear the matter.
    Lippman and Pfau, you know the FACTS that I was defribrillated five separate times and had two heart attacks and a stroke and if you didn't know that someone in cardiac intensive should not check out, you are either morons or corrupt judges.
    I've faxed and mailed a copy of this today to Lippman and Pfau, because Lippman and Pfau claim in earlier letters to me to have no power to control corrupt Acting Supreme Court Judges, who are acting at the whim of the court they administer. Lippman and Pfau allow them to act corruptly withouy control and supervision.
    Lippman and Pfau,I'm calling your cards, about "the court system’s mission of ensuring equal justice for all." You failed in your fundamental mission and then you ask for a raise? .

  6. An upstate newspaper yesterday reported that Senator Sampson was a "rank and file" Senator in Jan 2009, as his political coffer only had $1000 plus meager dollars.
    As of this Jan 2010...his coffer has been enhanced by an additional million plus...as his power in the Senate has skyrocketed.
    Looks like this Senator will not be taking on the judicial system in NY...as his newly enjoyed power and his extreme financial donations...even much larger than SILVER'S ... would be pulled away and from under him...in a NY second!
    That is why anyone from this state will never be the savior for judicial corruption...sorry, but predictably true.

  8. Part of the responsibility of the Chief Judge is to audit the courts.

    While there may be limited audits, there are no audits done on any area that would expose the corruption and sloppiness of the courts.

    I know from experience that if the courts and the attorneys were not as corrupt as they were, cases would not drag on for years by the victims. Why doesn't Lippman audit the judges that have cases which are continually and repeatedly in the courts?

    They always blame the victim.

    All these agencies and state employees should just do the jobs they are paid to do and there would be plenty of money and a lot less work and stress in their jobs if they didn't have to cover-up all the crimes that are going on.

  9. how about start by cutting thier extram money that they use for thinks like vacations and spa retreats. Wasnt thier an air purifier that one judge bought with thier extra money. What about cutting thier robe allowance. They only were it a few times a week for few minuts. Instead of getting them xpensive plain black robes give them $50 and let them take a walk to century 20 and by a black dress thier.
    What about cutting thier dry cleaning budget, every year get them a bottle of woolite. Or buy robes that do not have to be dry cleaned.
    Why do judges only work part time
    whey cant they work the mojority of the day.
    I have been to civil court were the judge did nothing the baliff called out the names and then the court volenters handeled the cases.
    The volenters worked thier for free. The judge refused to talk to anyone he spent the time talking to another court worker about his camping trip with the family at yosemetie. Despite having around 50 people in the courtroom he did not speak to one of the people that were thier to see the judge.

When I worked for OCA, I only saw audits conducted in the mid 90's for about 3 yrs....which sounds ethical...butttttt...the same male auditor stuck around every day...the same casually dressed guy...and he used the chief clerk's office as his own....sitting in her chair like I was supposed to ask him for information..that entire 3 yrs.

    The chief clerk was busy running around the court offices "drinking" it up all day long for years and messing with those who did not want to peep other employees activities....screaming and yelling at the top of her lungs...continuously...as CSEA said it was "OK" for us to work in that hostility!

    OCA was "very well" aware of her drinking and terrorizing behavior and the alleged same auditor sticking around for 3 yrs making his home in the "state court bldg" he was auditing, using her personal office and computer as his own. Who was he working for...really?

    That my folks is an OCA audit in it's raw and truest form..and I never saw another one conducted again in the next 10 yrs that I worked...and I would know, as I was married to a CPA WHO DID GOVERNMENT AUDITS FOR THE COUNTY!

    The judicial branch does not like real audits, as that would expose all that we are stating on this blog, and exquistely verified by professionals that are not lawyers(liars).

    This should prompt many citizens to request the latest audits performed in OCA courts...as accounting firms have a very strict set of standards...that OCA could never meet on this date in 2010!

    This is how Paterson could plead his case to the public, without Albany interferring with their unbelievable, coffer enhanced... BS!

    ...we can do this across the state, I know in Niagara County you will have lots of volunteers
    ...they tell me to do my research on the lawyer I need, for what so I can spend more money so they can payoff the lawyer or judge to deny my rights again or their next victim!

  21. If y'all thought you had problems before, you made it worse for yourselves by making complaints, and if you think making those complaints public will help, you're very wrong.

    You have no idea how your lives and the lives of your family, friends and associates will be endangered.

    These people have access to more information than you could even imagine. It only takes a phone call, and they can get just about anyone they want to stalk, threaten, harass and intimidate you and your associates.

    All it takes is a call. Don't look to the police for help, they are in on it also. And it won't just be someone who is currently on the job, but all those guys who retire after 20 years. They've had 20 years of training, and are not afraid to use it. Those guys also go into security and private investigation work, so they are everywhere. And they carry guns.

    So be afraid.

    Be very afraid.

Anyone know why instead the related federal cases got rocked and dismissed? sure, maybe say because NY is corrupt at both the state and federal level. but WHO is doing anything about this? surely will not be relying on Senator Sampson. why has Samspon not come out to support a special prosecutor yet? what about the so called Task Force that was to be set up? sampson and the judiciary committee have enough already to ask for a special prosecutor. i wouldn't believe anything about that committee supposedly doing something until they say they are asking the governor to get a special prosecutor. waiting for good news that is reliable.

    OCA is being watched and examined by sources that are beyond the lard butts they hire to wiretap you ,run you off the road or follow your family and friends.

  38. Just to clear a couple of things up.

    The police are in on it. It is on video tape.

    The police an investigators have been given a lot of technology and powers, and there is little accountability, just like the judicial system.

    Why hasn't anyone ever questioned why the police in New York don't have cameras in their cars?
    Just like anyone who has ever been involved with someone connected with the mob, you know what is going on, you can't do anything about it, as long as you can stay separate from it you're alright, but once you try to get out of it, you will find out how dangerous it is and how they can terrorize you and your friends.

    There is no help from anyone in the State. Not the OCA, the attorney or judiciary committees, Governor Patterson or his offices, the Attorney General's offices, including it's Public Integrity unit, Legal Aid, Legal Services, attorney committees nor any other government agency, public advocacy group, not Senator Sampson nor his office. You can also include the FBI and the DOJ.

    You would have had to assume that when the likes of Garson and Bruno got caught, they might turn to help themselves. They didn't because they didn't have to. They remain protected. I think this is prefectly clear since Garson got out early, there was no consequences to his behavior, and he will most likely get his law licence back.

    So don't think if they catch a couple more people, that anything will really change. It won't.

    To sum up, New York is a dangerous and corrupt state. New York has not changed from the days of political corruption under Tammany Hall and Boss Tweed of the 1800s through the mob of the twentieth century.

    If OCA ever shot or harmed anyone with information posted on this blog....the world would know...and you can never determine what crazinest would erupt from across the sea...esp since OCA is dominate in administration with a specific ethnic group and is holding trials on some of the most believed dangerous world's heros...and OCA knows their fear exists!
