Durst Trial Begins Today in Fraudulent Transfer of Tom Carvel's Home

POUGHKEEPSIE, NEW YORK - The theft of Ice Cream magnate Tom Carvel’s home will be the subject of a trial which began this morning, October 8, 2008, in Dutchess County, New York. Tom Carvel was found dead in the home on October 21, 1990 where, after seventeen years, it was only recently revealed that the ice cream icon’s death certificate had been forged. The Dutchess County court proceeding is set to determine damages from a bizarre real estate grab by “1133 Taconic, LLC, ” a company owned by New York real estate tycoon Douglas Durst.

A review of the case file reveals many specifics of the improper pirating of the home that overlooked the Thomas Carvel golf course. Mr. Durst had been negotiating the separate purchase of Tom Carvel’s private residence from 2001 through 2003. But at some point between late 2003 and early 2004, and after negotiations fell oddly silent, the Durst company simply obtained title to the property. Official records then showed that Durst owned all the land needed for an envisioned high-end housing development as he had previously purchased 2000 acres of Carvel property in 2001, which included the golf course, for a reported $8 million. Jury selection was completed Tuesday, October 7, 2008.

The only problem with the takeover of Tom Carvel’s home was that the Durst company did not actually buy the property. Someone had concocted a deed transfer based on the payment of back real estate taxes. The only problem with the Durst tax-lien-deed-transfer scheme was that Dutchess County does not allow such a procedure.

After a trial on the fraudulent real estate transfer in 2006, a court ordered the reversal of the deed from the Durst company back to the rightful owner. Records indicate that the same Judge who had signed off on the improper deed transfer to the Durst Company, and who would later order the correction of the fraudulent transfer, is also planned to preside over the jury trial for damages. Attorney John Loveless of Huff Wilkes is handling the court trial seeking damages from the Durst Company.

This just one of the scum. Way up north there is Kevin K. Ryan handing out the goodies. Every Surrogate Judge should be investigated. How about a special Surrogate Judge complaint and removal from the State Commission on Judicial Conduct with public reporting of all complaints. Light would disinfect these malignant bacteria.

I just read all the Carvel articles. Unbelieveable! I can understand Surrogate Judges Emanuelli and Scarpino's illegal actions because that's why they became Surrogate Judges -- to pass around the illgotten dollars of the deceased, and so they'd get their own cut of it..... that's just the way it is.

What I don't understand is why these two judges, along with a bunch of other lawyers, haven't been locked up yet. Troubling.

would love to know who the retired attorney is with the first comment. there a few like him in these parts upstate that have been able to get away with that sense of greed and entitlement. hopefully this Site and AG Cuomo will run down lawyers like this and change the way business is done in ny in the legal arena.
