Fifteen Years of Hell Over: Governor Paterson Appoints Justice Gonzalez

GOVERNOR PATERSON APPOINTS JUSTICE LUIS A. GONZALEZ AS PRESIDING JUSTICE OF THE APPELLATE DIVISION, FIRST JUDICIAL DEPARTMENT

Governor David A. Paterson today announced the historic appointment of Justice Luis A. Gonzalez to serve as Presiding Justice of the Appellate Division of the Supreme Court for the First Judicial Department.  Justice Gonzalez has been an Associate Justice on the Appellate Division, First Department for the last seven years. He has held a variety of civil, criminal and administrative judicial posts. He was the Administrative Judge of the Bronx Supreme Court from January 1999 to March 2002. In 1998, he served on the Appellate Term, First Department, and from 1993 to 1997 was a Justice of the Supreme Court, Bronx County. He was an Acting Justice in that same court in 1992 and from 1987 to 1992 was a Judge of the Civil Court of the City of New York. From 1985 to1986 he was in the Housing Part of the Civil Court, and prior to that was a Hearing Officer with the New York State Division of Housing and Community Renewal. From 1980 to 1981 Mr. Gonzalez was General Counsel of the South Bronx Community Housing and Development Corporation and from 1978 to 1980 was General Counsel to the Commonwealth of Puerto Rico as legal counsel to the National Director. Mr. Gonzalez was in private practice from 1976 to 1978 and was an Investigator with the New York City Department of Investigation from 1975 to 1976.

Justice Gonzalez, who is the first Latino to be appointed to this position, received his Bachelor of Arts degree from Eastern Mennonite University in 1968 and his Juris Doctor from Columbia University School of Law in 1975. “Throughout his career, Justice Gonzalez has displayed the strength of character and profound respect for the law that makes him an outstanding choice,” said Governor Paterson. “Justice Gonzalez has a compelling and inspiring life story and I have no doubt that he will continue to serve New Yorkers with great distinction. He is a true leader” Justice Luis A. Gonzalez said: “I am humbled and grateful to the Governor for entrusting in me the stewardship of the Appellate Division, First Department. I am committed and dedicated to preserving the preeminence that this court enjoys in the legal community. I am very much aware of the historical importance of this appointment and his trust and faith, I repeat, will always be appreciated.”

The First Department Judicial Screening Committee submitted seven names, each a sitting member of the court, to the Governor, all of whom were deemed “highly qualified.” All of the seven candidates displayed integrity, independence, leadership, intellect, legal ability, judgment, temperament and experience.  Governor Paterson added: “I was presented with outstanding candidates from which to choose and I salute each of them. Justice Gonzalez will assume leadership of a very talented and tremendously significant court.” Under the New York State Constitution and Judiciary Law, the Governor has the authority to appoint the Presiding Justice of each Appellate Division from among those who have been elected as Justices of the Supreme Court. The Governor’s appointment is not subject to Senate confirmation.  The annual salary for the Presiding Justice is $147,600.

I have good feelings about Judge Gonzalez. He might actually correct some of the horrific things that have happened in the ad1 over the last decade. I don't know about 15 years, and I have to do more research but my memory says things got corrupt about 10 years ago, but I could be wrong. Whatever the case, things are very bad right now and Judge Gonzalez is surely welcomed.

By the way, I've been practicing for 50 years!

While anyone would be better than the group of misfits that we've have at the First Department, Judge Gonzalez is someone I trust and believe will restore the once high dignity and respect for the law that the appellate court had.

Mazzarelli and Gonzalez are named DEFENDANTS in a Trillion Dollar Federal Lawsuit in the Court of Appeals 2nd. Circ., this must be weighed before they are nominated for anything but jail time for their part in what Shira Scheindlin has called a MURDER case and Harry I. Moatz of the United States Patent & Trademark Office has called a FRAUD ON THE USPTO. They get my vote though for we must trail closely how these goons position to derail justice for all.
The case centers on the law firms Proskauer Rose, Foley & Lardner & Meltzer Lippe stealing patents from their former client Iviewit Technologies and then attempting to MURDER the main inventor, dear ole me, Eliot Bernstein by putting a bomb in my minivan that blew up three cars next to it. These two judges ordered investigations into Proskauer partners, Kenneth Rubenstein (Patent idiot for MPEGLA, oh yeah, all you who have been paying for MPEG licenses have been paying the wrong guys for the technologies and soon will have to pay the right guy, so start asking for your money back) and Proskauer idiot Steven C. Krane former President of the NYSBA both ordered for investigation for Conflict of Interest & The Appearance of Impropriety. We must ask Mazzarelli and Gonzalez what happened to their Unpublished Orders for Investigations and how they handled the resulting conflicts that were found in that joke non investigation at the 2nd Department where the investigator admitted conflict with Krane. We must ask these two judges if they have reported the TRILLION DOLLAR liability to their insurance carriers and state auditors or else they could be perpetuating a TRILLION DOLLAR Insurance Fraud on the GREAT STATE OF NEW YORK and Insurance Companies and thus they should be judged before sentencing. Many state actors and agencies have been sued in the case, related legally to an inside Whistleblower case of Christine Anderson who was physically assaulted to keep the lid on the WHITEWASHING of complaints at the First Department. Someone should contact the state auditor and the personal liability carriers for these guys before nominating them to toilet cleaners at the First Department and not the Big House.
Judith Kaye is also a DEFENDANT and I wonder if Judge Judy has reported this liability to her liability carrier, the state auditor for the agencies she tagged with the liability or her new law firm Skadden Arps Slate Meagher & Flom (wonder if they have insurance). HMMMM - sounds like MASSIVE TRILLION DOLLAR FRAUD. How long will they keep the exposure to the PEOPLE of NY going, hiding their obligations of reporting the liability?
Remember Scheindlin in her opinion called it a MURDER case, do they kill those who are trying to expose them, by the looks of the bomb in my car it sure looks like it.
This scam is far bigger than MADOFF + STANFORD + DREIER all put together and could have massive impact on STATE FUNDS putting New Yorkers at risk. So, at their secret confirmation hearings Governor Patterson and the NYAG and the FBI, etc. should show up to ask the tough questions.
Again, they have my vote, as I love to fingerprint scumbags dressed up as lawyers and judges.

Welcome Mr. Gonzalez, you gotta lotta splainin to do regarding your involvement in the Iviewit MURDER ( according to Judge Shira Scheinlin ) + ATTEMPTED MURDER + PATENT THEFT case you are a named DEFENDANT in at the Court of Appeals. Like how you ruled to investigate Steven C. Krane (former President of the NYSBA) and Kenneth Rubenstein ( MPEGLA LLC patent reviewer )both from Proskauer Rose who violated all kinds of ethics rules at the 1st Dept and then you did not enforce the investigations you ordered. Instead you transferred to a conflicted investigator, D. Kearse @ the 2nd Department who failed to investigate what you ordered for investigation stating she was not obligated by your UNPUBLISHED ORDERS. This failure allowed people to put a bomb in my car my friend. Have you reported your involvement in this case to Patterson, did he know, is he aware of the liability to the state and your insurance carriers you have caused or are you hiding that from the public you are exposing to the risks.

Plumadore should retire before he gets removed for his nasty involvement in some very slick criminal conduct...he assumed would never be realized or get exposed.
Jan..you just never knew who you screwed with..not smart for a Viet Nam Vet, who had been trained to sniff out trouble!
A retirement would not resolve your problems..but make them less effective and embarr-assing...publicly.

Friedberg was told last week that changes were in the works and he was asked if he had any plans to retire or if he had a preference on where he'd be moved to.

He's no longer welcomed at 61 Broadway. Except for cleaning the toilets, I guess.

If Gonzales is honest, then this pick is Paterspn's swan song. Noble, brave as hell, but probably politically suicidal, because if Gonzales investigates recent DDC (and the first dept) improprieties, the finger of guilt will swing directly to Lippman and Silver.

Of course, if they get led away in cuffs, Paterson may emerge resplendent,

If Gonzales is just another lowlife thug, Paterson will be out anyway, but will go down as history as another pathetic tool of Silver.

Maybe the Gonzales is "Paterson;s revenge"? How sweet that would be.
