Governor Asked to Confront Presiding Judge Candidates on Corruption

RE: Appointment of Presiding Justice of Appellate Division, First Department

Dear Governor Paterson:

As you consider whom to appoint as the next Presiding Justice of the Appellate Division, First Department, we respectfully ask you to consider the following.

As you and your staff are fully aware, our research has revealed, and fully documented, a troubling state court “ethics” oversight structure that is itself corrupt. We have documented countless examples where the law, attorneys, litigants, state employees and, in fact, judges have been targeted for annihilation simply because of a political whim or from the vengeful, misguided desires of a few. Conversely, we have evidence of many outrageous and criminal acts by certain individuals within and about the state court system that have been substantively overlooked for no other reason than their favored position or political affiliation.

What you might not know is that within the last 30 days, we presented three (3) judges to appropriate federal entities in Washington, D.C. who personally appeared in support of the need for extraordinary measures to deal with the outrageous conduct of the New York State Commission on Judicial Conduct, which is irreversibly corrupt, statewide attorney "ethics" committees and, specifically, the Manhattan attorney “ethics” committee, the Departmental Disciplinary Committee (“DDC”). (Incidentally, we have over two dozen judges who will similarly testify as to the corruption within New York’s “ethics” entities.)

We believe that any candidate for the position of Presiding Justice of the Appellate Division, First Department, and who will be responsible for all DDC activity, should adequately review and be able to sufficiently deal with the current and past criminal acts conducted at the DDC, mostly under the supervision of DDC chief counsel Alan Friedberg, his predecessor Thomas Cahill, and at all times under deputy chief counsel Sherry Cohen.

Over the next few days we will specifically list for you some of the many criminal acts at the DDC. Meanwhile, we ask that you ask every candidate for Presiding Justice of the Appellate Division, First Department, two questions:

(1) Have you read “The Murphy Report?”
(available at the bottom of page one at www.FrankBrady.org); and

(2) Are you aware of the allegations of state and federal criminal acts at the DDC

Your gubernatorial presence has renewed the promise of hope to the great people of New York. We have long yearned for leadership in reforming the condition of avarice and corruption that exists within and about our state’s court system. We need you to insure that the First Department is led by a Presiding Judge who is committed to equal justice over all ethics issues.

The "Federal entities" were aghast at the testimony of the three (3) judges who stated the facts of the matter are plain that the CJC and the DDC's are necessary entities staffed by corrupt people who perform the unchecked commission of Federal crimes, a systemic case of RICO in NY. One Judge defined the standard of RICO and all participants agreed that the NY matters have met the test.

Mazzarelli and Gonzalez are named DEFENDANTS in a Trillion Dollar Federal Lawsuit in the Court of Appeals 2nd. Circ., this must be weighed before they are nominated for anything but jail time for their part in what Shira Scheindlin has called a MURDER case and Harry I. Moatz of the United States Patent & Trademark Office has called a FRAUD ON THE USPTO. They get my vote though for we must trail closely how these goons position to derail justice for all.
The case centers on the law firms Proskauer Rose, Foley & Lardner & Meltzer Lippe stealing patents from their former client Iviewit Technologies and then attempting to MURDER the main inventor, dear ole me, Eliot Bernstein by putting a bomb in my minivan that blew up three cars next to it. These two judges ordered investigations into Proskauer partners, Kenneth Rubenstein (Patent idiot for MPEGLA, oh yeah, all you who have been paying for MPEG licenses have been paying the wrong guys for the technologies and soon will have to pay the right guy, so start asking for your money back) and Proskauer idiot Steven C. Krane former President of the NYSBA both ordered for investigation for Conflict of Interest & The Appearance of Impropriety. We must ask Mazzarelli and Gonzalez what happened to their Unpublished Orders for Investigations and how they handled the resulting conflicts that were found in that joke non investigation at the 2nd Department where the investigator admitted conflict with Krane. We must ask these two judges if they have reported the TRILLION DOLLAR liability to their insurance carriers and state auditors or else they could be perpetuating a TRILLION DOLLAR Insurance Fraud on the GREAT STATE OF NEW YORK and Insurance Companies and thus they should be judged before sentencing. Many state actors and agencies have been sued in the case, related legally to an inside Whistleblower case of Christine Anderson who was physically assaulted to keep the lid on the WHITEWASHING of complaints at the First Department. Someone should contact the state auditor and the personal liability carriers for these guys before nominating them to toilet cleaners at the First Department and not the Big House.
Judith Kaye is also a DEFENDANT and I wonder if Judge Judy has reported this liability to her liability carrier, the state auditor for the agencies she tagged with the liability or her new law firm Skadden Arps Slate Meagher & Flom (wonder if they have insurance). HMMMM - sounds like MASSIVE TRILLION DOLLAR FRAUD. How long will they keep the exposure to the PEOPLE of NY going, hiding their obligations of reporting the liability?
Remember Scheindlin in her opinion called it a MURDER case, do they kill those who are trying to expose them, by the looks of the bomb in my car it sure looks like it.
This scam is far bigger than MADOFF + STANFORD + DREIER all put together and could have massive impact on STATE FUNDS putting New Yorkers at risk. So, at their secret confirmation hearings Governor Patterson and the NYAG and the FBI, etc. should show up to ask the tough questions.
Again, they have my vote, as I love to fingerprint scumbags dressed up as lawyers and judges.

The Appellate Division 1st Dept. has, very sadly, become a sewer of corruption. Just look what has happened under them in the last dozen years. They have lost all respect from any honest attorney. Disgraceful.

The Governor has hopefully by now realized that Shelly Silver has worked him like a two bit hoar. Yes, the time is right for this Governor to stand up and really do something for all the peoples of New York State, not just the ones who brown their nose by its close proximity to Silver's fat ass. We need a real shake up Governor Patterson. It's also a good time because from what I read your numbers can't get much lower. Be the hero we've been waiting for AND DO SOMETHING BIG.

Eliot Bernstein/Bat Out of Hell did not list one of the related case to the Anderson matter namely John L. Petrec - Tolino v. The State of New York, et al., lets not forget a brother.

The Judges will never do anything because its not in their best interest. It must be some outside force to be effective. Self policing doesn't work since we can all see the far from stellar results.

Other than that it appears that everyone is on the same page at this time. I second Galison's comments.

So, even honest judges can't get a fair shake in this sh*t hole state. Time for the federal government to march on Broadway.... right to 61 BROADWAY, the home of the DDC and the DCJ !!!!!!!! I've known Friedberg for years. You really can't get more corrupt than that little piece of dirt. If you shake his hand, check you fingers.
