Governor Must Ask Presiding Judge Candidates About Corruption

The Governor must ask the candidates for the Presiding Justice of the First Department opening about the systemic corruption in and about the Manhattan Ethics Committee (the "DDC") and, importantly the statewide corruption within the Commission on Judicial Conduct...More on this later today.....

Four Judges Line Up Top Post Interviews
The New York Law Journal by Joel Stashenko - March 23, 2009

ALBANY, N.Y. - Governor David A. Paterson has scheduled interviews for today with his top four candidates for the vacant presiding judgeship of the Appellate Division, First Department, sources familiar with the selection process said.  All four are members of the Manhattan-based First Department: Justices Rolando T. Acosta, Luis A. Gonzalez and Angela M. Mazzarelli, and Acting Presiding Justice Peter Tom.

The interviews were scheduled to take place in Albany. One source said the sessions could stretch past today depending on last-minute changes in the schedule of Mr. Paterson, who is attempting to negotiate a new state budget with legislative leaders by April 1 for the 2009-10 fiscal year.  The governor is not expected to interview any other candidates to fill the opening he created when he selected former Presiding Justice Jonathan Lippman as chief judge to succeed the retired Judith S. Kaye (NYLJ, Jan. 14). While Mr. Paterson said he was deeply impressed by Justice Lippman's credentials, the governor also complained about the nomination process that forced him to choose from a list of candidates from the Commission on Judicial Nomination that included seven men, six of them white (NYLJ, Dec. 4, 2008). Mr. Paterson said the list did not reflect the racial or gender diversity of the state.

Still in the Running

Rolando T. Acosta, 53

A former Legal Aid Society attorney, Justice Acosta was elected to Manhattan Supreme Court in 2002 and was among the first two selections of then-Governor Eliot Spitzer to the Appellate Division in 2007. He is a Columbia Law graduate.

Luis A. Gonzalez, 63

Elected to the Bronx Supreme Court in 1992, he was administrative judge in the 12th Judicial District from 1999 to 2002. He was appointed to the Appellate Division in 2002 by Governor George E. Pataki. Justice Gonzalez is a Columbia Law graduate.

Peter Tom, 62

The current acting presiding justice was elected to Manhattan Supreme Court in 1990. Justice Tom became the first - and is still the only - Asian-American on the Appellate Division with his appointment in 1994 by Governor Mario M. Cuomo. Justice Tom is a Brooklyn Law School graduate who once won a New York City Golden Gloves boxing championship.

Angela M. Mazzarelli, 62

A Columbia Law School graduate and former Bronx Legal Services attorney, she was elected to Manhattan Supreme Court in 1992 after four years as an acting Supreme Court justice. Justice Mazzarelli was appointed to the Appellate Division in 1994 by Mr. Cuomo. Of the four candidates for the First Department position, Justice Tom is Asian-American, Justice Mazzarelli is a white woman and Justices Gonzalez and Acosta are Hispanic.  No Asian-American or Hispanic has been a permanent presiding Appellate Division justice, although Carmen Beauchamp Ciparick, a Hispanic, is senior associate judge on the Court of Appeals. Three women have served as a presiding justice, including A. Gail Prudenti, the current presiding justice in the Second Department.

Since becoming governor last year, Mr. Paterson, who is black, has shown an inclination to promote minority judges or women to the Appellate Division. Of his eight appointments, two have been black men, two black women, three white women and one white man. It was not known how many of the presiding justice candidates were declared "highly qualified" by the First Department Judicial Screening Committee. Mr. Paterson can choose only among candidates found to be "highly qualified" by the committee. Sources have told the New York Law Journal that at least three other sitting First Department judges applied for the presiding judgeship. In addition to the four Mr. Paterson will interview, Justices Richard T. Andrias, David B. Saxe and Dianne T. Renwick also applied (NYLJ, March 11). Gubernatorial appointments to the Appellate Division do not require confirmation by the state Senate. Joel.Stashenko@incisivemedia.com

And the new PJ has to be committed to firing Alan Friedberg and Roy Reardon, two big corrupt hacks.

And I'd like to see the new PJ come out publicly and ask for a criminal investigation into what Bob Tembeckjian, and his criminal group of whitewashers, have been covering up at the CJC.

they will not talk.
start serving papers and get them to talk under oath. In a closed door hearing.
Disclose judges "donations" to groups.
make public the files on judges records that are kept by the office of court administration on Beaver street.

Paterson will screw this up like he has everything else.

Stashenko, you bozo,

Racial and Gender diversity was never an issue.
Why don't you grow a pair and do some real reporting.
You are the Geobbels of the corrupt judiciary, a disgrace to your profession and a frickin menace to New York.

Mazzarelli and Gonzalez are named DEFENDANTS in a Trillion Dollar Federal Lawsuit in the Court of Appeals 2nd. Circ., this must be weighed before they are nominated for anything but jail time for their part in what Shira Scheindlin has called a MURDER case and Harry I. Moatz of the United States Patent & Trademark Office has called a FRAUD ON THE USPTO. They get my vote though for we must trail closely how these goons position to derail justice for all.
The case centers on the law firms Proskauer Rose, Foley & Lardner & Meltzer Lippe stealing patents from their former client Iviewit Technologies and then attempting to MURDER the main inventor, dear ole me, Eliot Bernstein by putting a bomb in my minivan that blew up three cars next to it. These two judges ordered investigations into Proskauer partners, Kenneth Rubenstein (Patent idiot for MPEGLA, oh yeah, all you who have been paying for MPEG licenses have been paying the wrong guys for the technologies and soon will have to pay the right guy, so start asking for your money back) and Proskauer idiot Steven C. Krane former President of the NYSBA both ordered for investigation for Conflict of Interest & The Appearance of Impropriety. We must ask Mazzarelli and Gonzalez what happened to their Unpublished Orders for Investigations and how they handled the resulting conflicts that were found in that joke non investigation at the 2nd Department where the investigator admitted conflict with Krane. We must ask these two judges if they have reported the TRILLION DOLLAR liability to their insurance carriers and state auditors or else they could be perpetuating a TRILLION DOLLAR Insurance Fraud on the GREAT STATE OF NEW YORK and Insurance Companies and thus they should be judged before sentencing. Many state actors and agencies have been sued in the case, related legally to an inside Whistleblower case of Christine Anderson who was physically assaulted to keep the lid on the WHITEWASHING of complaints at the First Department. Someone should contact the state auditor and the personal liability carriers for these guys before nominating them to toilet cleaners at the First Department and not the Big House.
Judith Kaye is also a DEFENDANT and I wonder if Judge Judy has reported this liability to her liability carrier, the state auditor for the agencies she tagged with the liability or her new law firm Skadden Arps Slate Meagher & Flom (wonder if they have insurance). HMMMM - sounds like MASSIVE TRILLION DOLLAR FRAUD. How long will they keep the exposure to the PEOPLE of NY going, hiding their obligations of reporting the liability?
Remember Scheindlin in her opinion called it a MURDER case, do they kill those who are trying to expose them, by the looks of the bomb in my car it sure looks like it.
This scam is far bigger than MADOFF + STANFORD + DREIER all put together and could have massive impact on STATE FUNDS putting New Yorkers at risk. So, at their secret confirmation hearings Governor Patterson and the NYAG and the FBI, etc. should show up to ask the tough questions.
Again, they have my vote, as I love to fingerprint scumbags dressed up as lawyers and judges.

A few pockets of the administrative legal branch of the government are probably unethical, but there are many individuals who have given their lives to government work and do amazing and wonderful things to help people and protect consumers.

There was one man I came across who really portraits the lack of ethics in the government and that is Harry Moaz. His call, his words and judgement mean nothing to me.. since he is eager to defend people who defraud and exploit people for false gain, and slam people for trivialities in paperwork re practice of law. He has failed to see the point, he has failed protect consumers, he has failed at his job.

The very fact that Harry Moatz and James Toupin even tried to establish a federal law that he HIMSELF and his office would be immune from unethical behavior or misconduct in the course of their duties??? is so hypocritical and completely lacking in sound judgement they should have been fired for the very attempt.
