Judicial Meltdown Renews Call for New Administrative Judge.....(MORE, CLICK HERE)

If the judicial meltdown that occurred in Westchester County the other day was seen- or heard- in any of the 5 boroughs, it would have been on the front page of every area newspaper. Thankfully, top Journal News reporter Jonathan Bandler went with the story on Tuesday, November 20, 2007. "You could hear the screaming and yelling throughout the courthouse," says one insider. Apparently, a huge dark cloud has been hovering over the 10-year-long tactics of the current 9th Judicial District Administrative Judge Francis A. Nicolai....MORE.....

Recanting witness to resume testimony today in deli shooting

WHITE PLAINS - After a bizarre end to yesterday's session, testimony is expected to resume this morning from a witness who has recanted his testimony from the 1997 murder trial of off-duty NYPD officer Richard DiGuglielmo.

Lawyers, relatives of DiGuglielmo and victim Charles Campbell and others sat for nearly two hours waiting for Westchester County Judge Rory Bellantoni before court officers announced the session was adjourned for the day.

The judge did not believe it was appropriate for him to take the bench after his blood pressure soared during a lengthy phone conversation with Administrative Judge Francis Nicolai about an unrelated matter. The conversation began at the end of the lunch break after Bellantoni received a letter he considered disrespectful from a member of Nicolai's staff. He said the judge then berated him at length.

The two recently were among six candidates for state Supreme Court. Nicolai won one of three seats. Bellantoni did not.

After the argument, Nicolai refused to discuss the matter, saying only that it was a "frank and open conversation about courthouse matters."

Court staff heard the yelling on the phone but it could not be heard in the courtroom. The judge said afterward he could not settle down enough to resume the hearing.

DiGuglielmo was convicted of second-degree murder for the shooting of Charles Campbell on Oct. 3, 1996, in the parking lot of the Venice Deli on Ashford Avenue in Dobbs Ferry. Campbell had struck DiGuglielmo's father with a baseball bat after a confrontation over Campbell's parking in the lot while getting pizza across the street. The jury rejected DiGuglielmo's claim that he was defending his father.

Yesterday morning , Michael Dillon, a cable technician who happened by the scene that night, said his original account to detectives on the night of the shooting - that Campbell was still swinging his bat when he was shot - was accurate. He said detectives took him to headquarters three more times that week before he changed his statement to indicate Campbell was backing off and the shooting did not appear to be justified.

That was the testimony he gave at trial as well. The defense cross-examined Dillon about the change during the trial - but say now they would have done so more extensively if they had known about the intervening interviews.

Elsewhere on this blog, someone commented that Judge Nicolai wears a black dress, this is a very insightful observation in my opinion.

The damage that Judge Nicolai has done to faith in the law and courts, families and members of the legal profession is impossible to fully grasp. His departure is long overdue. I have been around many of his outbursts. He has lost touch with reality and is completely out of control.

While a very strong argument could be made for Nicolai's arrest, for various betrayals of the public trust (I'm being kind), he should simply retire and go away.

I heard he's going to be replaced as Administrative Judge, and that's why he's so off the wall with anger.

Also, I heard some of the young lawyers that work for him are sick and tired of breaking the law because of some dumb thought that missed his ass and landed in his mouth, only to then be proclaimed for jolly old Nic(olai)as if he's some kind of king. (one female court lawyer recently went to higher ups at OCA to complain, and boy is she scared.)

I heard that what Judge Rory Bellantoni endured from his boss Judge Nicolai was too much. He should file a complaint, I would.

If I were Judge Kaye and read this story about Judge Nicolai, I would have him on the phone posthaste. I don't think that I'd be reading this type of thing in a newspaper, if there was any kind of supervision.

Something really smells in Westchester County, and it's not turkey! There's another article in today's Journal News. Westchester case fixing really stinks. Nicolai is a diseased turkey who should be immediately replaced as Admin. Judge.

Everyone in the legal community is concered about the news reports regarding Judge Nicolai and Judge Bellantoni. One court worker related to me what had happened. No matter who was right and who was wrong, they should both shake hands and get over it for the sake of the Judiciary. I know from personal experience that Judge Nicolai can be overbearing. Also, cutout this stuff about Judge Nicolai or any Judge wearing black dresses, that's not right.

Maybe if this site printed stories of corruption,lawsuits and illegal behavior within courts outside of NYC and throughout the entire state of NY.... a FEDERAL MONITOR would appear to be a necessity , because it would not seem as just the corruption is in NYC, with a handful of the same JUDGES NAMES always appearing! This is just my opinion, because i know of big corruption elsewhere in NY , outside of the CITY ,and if no one else knows this on the internet, the push for federal accountability is viewed unecessary because it encompasses an isolated area with a few bad smells!

I agree with you entirely..just need facts and names of other court corruption to be revealed here and i guarantee you will see this site light up with other wild stories. some people believe this is just a site for nyc judicial issues and are too intimidated to mention their area for fear it would be out of place. just need to encourage them to break out their outrage!

I've watched Frank and his brother giving hand signals to drivers as to who would win and who would lose. Yes, the races are fixed and there is no Santa Claus, but don't tell anyone! Knowing how they fix races I can see them fixing case in court the same way.
