Mark F. Pomerantz To Be Named SDNY U.S. Attorney

BREAKING NEWS:  Mark F. Pomerantz To Be Named SDNY U.S. Attorney...MORE...A source within President-Elect Barack Obama's Chicago's office confirmed early this morning that Mark F. Pomerantz will be appointed as the United States Attorney for the Southern District of New York. Mr. Pomerantz is currently a partner in the Litigation Department at Paul, Weiss, Rifkind, Wharton & Garrison, LLP in Manhattan.  REJOICE, NEW YORK, this guy is what we've been waiting for........ Not included in its report was the commission's most significant event during that time - the resignation of its former chairman Mark Pomerantz.

Pomerantz resigned after Police Commissioner Raymond W. Kelly refused to release documents the commission had sought to determine whether the NYPD was downgrading felonies to misdemeanors so that the city's crime rate would appear lower than it actually was.

Mayor Michael Bloomberg - who appointed Pomerantz and who during his 2001 mayoral campaign had promised a "more transparent" police department than existed under his predecessor, Rudolph Giuliani - didn't utter a peep when Pomerantz resigned.

Pomerantz is no mere do-gooder with his head in the clouds.He was a career federal prosecutor who helped convict ex-cop Frank Livoti in the death of Anthony Baez of the Bronx, following Livoti's use of a department-banned choke-hold.Now working for the midtown law firm of Paul, Weiss, he declined comment.

The Commission's chairman was former federal prosecutor Mark Pomerantz.Pomerantz sought NYPD records following allegations by the PBA (Patrolmen's Benevolent Association, a union of NYPD police officers) that NYPD commanders were downgrading crimes from felonies to misdemeanors to create misleading crime statistics.

Mark's a class guy. If he sees ANY conflict, he'll bring in someone from out of town. You can't question this guy's character. His is tough, fair and the man for the job.

As this blog has said, the NY state legal system as a whole is a complete cesspool of corruption. Part of the problem is the NYPD brass and the one-hundred-and-sixty-year-old Manhattan district attorney. A guy with balls, a guy like Pomerantz, is the only kind of person who could make some real changes. I've had my battles with Pomerantz but I have to say he is a man of conviction, one who can stand up to the real criminals.

how do Average New Yorkers get to know the truth on AIG's role in the Financial Meltdown of Wall Street and what about the unanswered questions on spitzer and his role as AG during the Pataki years?

Pomerantz has done it all, been everywhere, and, most importantly has already made his money (hello Mr. Garcia!). Pomerantz know politics, he knows how dirty and brutal New York 'business' can be, he knows the good and BAD of the NEW YORK legal profession, he knows what's good and BAD in big and small law firms. Most importantly, he's not afraid to take on corrupt prosecutors, corrupt cops, corrupt District Attorneys- and guess what, we have a boat load of those around these parts! Pomerantz has fought against prosecutorial misconduct: state and federal. THAT'S WHAT WE NEED IN NEW YORK. If you bring in an outsider from Alaska, say, they'll be eaten alive by Morganthau's famous dirty tricks. THIS IS A GREAT CHOICE.

Pomerantz was a a former chief of the criminal division for the US attorney’s office for the Southern District of New York, the same group that was prosecuting Governor Spitzer (until Michael Garcia dropped it). And guess what? The same Pomerantz was hired to defend horny Eliot. Conflicts? Maybe. But if they appointed Jesus Christ to be the US Attorney for the SDNY, he'd be crucified (wait, bad example) It's foolish to think we'll get the perfect person from Ohio. OK, so the guy knows both sides; maybe that's good. But he apparently has integrity, and he gets my vote for that alone. What are the alternatives? Jeannine Pirro? (former Westchester DA and grandmother of corrupt prosecutors) or how about Eliot Spitzer (who got us in most of the messes we have here now (protecting friends from prosecution and destroying innocent people) No easy choice, to be honest. We'll never get an alter boy, and we don't need an alter boy. I like Pomerantz

Importantly, Pomerantz is a good manager and people respect him. He's done a lot of public work so he knows the SDNY prosecutor's office needs to do more to go after the people who are screwing the everyday people- like corrupt cops, dirty d.a.'s, corrupt judges, dishonest lawyers and others who violate the public trust.

The chairman of the Mayor's Commission to Combat Police Corruption, who told the City Council on Monday that his panel needed subpoena power and that disputes with the Police Department had reduced the commission's effectiveness, said yesterday that he would resign on June 1.

The chairman, Mark F. Pomerantz, a former federal prosecutor and a partner with the law firm of Paul, Weiss, Rifkind, Wharton & Garrison, said he was resigning from the unpaid post because his commission duties required more time than he could spare from his law practice. Mr. Pomerantz, among other clients, represents the American International Group, the insurance giant facing state and federal regulatory investigations into possible financial manipulation.

He said his decision had nothing to do with his testimony before the Council on Monday, noting he had told the mayor's office of his intention to resign roughly a month ago, long before the hearing was scheduled. Mr. Pomerantz, who served as the commission's chairman for 18 months, sent a letter of resignation to Mayor Michael R. Bloomberg on April 14. His resignation was first reported yesterday in The Daily News.

"I tendered my resignation from the C.C.P.C. because the job of chairing the commission required more time than I had available to do it," he said in an e-mail message. "Doing the job in the right way, in the absence of subpoena power, requires ongoing discussion with the Police Department about the commission's jurisdiction and access to information."

At the hearing on Monday, Mr. Pomerantz told the Council's Public Safety Committee that the commission had sought to review fraudulent claims for police overtime and sexual misconduct and domestic violence by officers, but was stymied by the department's failure to provide information. He said such jurisdictional disputes had been common in his tenure heading the six-member panel, which he said would be more effective if it had subpoena power, something the department has long fought.

He said in a recent interview that the panel also wanted to examine the integrity of the department's crime statistics reporting, procedures that have been broadly criticized by police union leaders. They have contended that police commanders downgrade some crimes to lesser offenses to drive down the reported number of some more serious crimes, like robbery, burglary and grand larceny, which are closely watched. At least half a dozen commanders have been investigated in connection with downgrading crimes in recent years.

Police Department officials have said that the reviews the commission is seeking to conduct do not fall under the panel's mandate; they contend that matters like overtime fraud and falsifying crime statistics do not constitute corruption. The department's chief spokesman, Paul J. Browne, has said that the department has given the panel full access to case files and other information in "every case where misconduct rose to a level meriting a corruption investigation." That, he said, would include misconduct involving crime statistics that rose to the level of what he termed "serious corruption."

The commission was formed in 1995 by Mayor Rudolph W. Giuliani after the Mollen Commission raised questions about the department's ability to police itself and recommended an independent panel with subpoena power. Mr. Giuliani fought the City Council's effort to form such a panel and won a lawsuit barring its creation.

The commission has a $500,000 budget and a permanent staff of four lawyers. It audits and studies the department's anticorruption strategies. It has been criticized as ineffectual because it has no power to compel the department to provide information. The six commissioners, all lawyers, are appointed by the mayor and serve without pay. The staff is paid by the city and serves at the pleasure of the mayor. No successor for Mr. Pomerantz has been named.
