NY's Chief Judge, at "End of My Patience," Says She'll Sue Over Judges' Pay

Chief Judge Judith S. Kaye says she may file a lawsuit next month if state lawmakers end a planned December session without voting to give raises to New York's judges.
She said she expects lawmakers to return to Albany in mid-December. If they fail then to hike New York's judicial salaries, which are the 48th lowest in the nation, the chief judge said she may sue the state.
"I so don't want to do that," Chief Judge Kaye told The Associated Press. "I've been a lawyer for 45 years, and I know the pluses and minuses of litigation. To me it is a last resort, but I've come just about to the end of my patience. If they don't do it now, they'll come back in an election year, and nobody wants to talk about raises in an election year."
Governor Eliot Spitzer's office did not reply to numerous messages seeking comment on the dispute.
The sticking point has been that salary hikes for lawmakers and judges have historically been linked, and Mr. Spitzer has balked at increasing the lawmakers' pay.
The chief judge said lawmakers' failure to vote on a pay hike during the past nine years is effectively, given the rate of inflation, a pay cut and an intrusion on judicial independence, and therefore illegal.
The chief judge first raised the possibility of filing a suit on behalf of the Judiciary in April. She has since said repeatedly that while legal action remains an option, it would be a last resort if the Legislature and governor fail to act voluntarily to boost judges' pay.
Meanwhile, two lawsuits have been filed, one on behalf of individual judges and the other with the support of several judges' associations.

Judge Kaye's sole purpose for this "red herring" is to make smoke and muddy the waters of scandal and corruption and just maybe she can get out before anyone figures it out! Mark my words!
If Judge Judith Kaye sues I have lost any respect I have for her. The taxpayers of New York State should personally sue her and all the other Judges for "Honest Services" among other things. We are not serfs for them, they work for US!
I will make sure KAYE'S REPUTATION IN THIS CORRUPTION REMAINS IN TACT...I HAVE INFORMATION FILED THAT NO MATTER HOW LONG SHE PROLONGS OR IGNORES IT, IT WILL BLOW UP, EVENTUALLY! SHE SAYS SHE HAS LITIGATED OVER 40 YRS...WELL SHE IS THE MOST POORLY INTUITIVE LAWYER I HAVE EVER SEEN...SHE HAS JUST BLOWN ONE OF THE BIGGEST LEGAL MANUEVERS SHE HAS EVER MADE IN HER OLD ASS LIFE! A RAISE FOR THOSE OF THE JUDICIARY IS BROKEN....BECUASE OF JUDITH KAYE...CONGRATS BIG MAMMA!
what is she a lobyist for the judges?
Look how far these people are disconected from reality.
If everyone could sue because they thought they were not being paid enough for the job they do the courts would be open 24 hours a day 7 days a week and still could not keep up.
If Kaye sues for higher pay can taxpayers should sue her for wasting taxpayer dollars.
Does she know who she works for?
If you do not like the pay/job or working conditions you do like every other american in this country does you GET ANOTHER JOB.
No one forced them to run for office no one made them become a judge.
She isn't rich enough? Her husband was a partner at a big law firm and was her bag man. Judy do you want more money than your sister Judge Judy on TV? Why don't you just go get a young boy friend or whatever!
Judy Kaye is a repulsive and nasty woman with looks to match! She needs a raise to entice a younger man to be with her and that is just for an escort. This woman is a disaster as a judge, lawyer and female....get her the hell out now, before she apears in the newspapers anymore...i am ashamed of her 100%!
Enough with your shtick already Judith, even your mother would be ashamed of you by now, stop.
I say to you and your fellow so-called judges what you said to me on my case DENIED, DENIED, DENIED - If it were up to me I would cut their pay and stop their pensions! I really don't think anyone would miss the whole lot of them!
