New Boss Coming to Head NY's Tammany Hall II Corruption

U.S. Attorney in Manhattan May Leave for Private Sector
The New York Times By BENJAMIN WEISER - November 8, 2008

Michael J. Garcia, the United States attorney in Manhattan who oversaw a series of high-profile corruption cases, including one that led to the resignation of Gov. Eliot Spitzer, has decided to leave his post early and will join a private law firm, lawyers familiar with his plans say.His departure could be announced as early as next week.

Mr. Garcia, 47, who has been in his post for three years, is expected to be succeeded, at least temporarily, by his deputy, Lev L. Dassin, a veteran prosecutor. Mr. Garcia said this week that he would not seek charges against Mr. Spitzer for patronizing a prostitution ring. Beyond that case, he prosecuted several state politicians and city officials; former Police Commissioner Bernard B. Kerik; and the Democratic political fund-raiser Norman Hsu. Most of those cases are still pending, with the defendants pleading not guilty. The Manhattan office, one of the largest federal attorney’s offices, has handled some of the most important terrorism and securities fraud prosecutions. Just last month, Mr. Garcia joined with the New York State attorney general, Andrew M. Cuomo, in an inquiry into credit-default swaps, the unregulated financial instruments at the center of the current meltdown.

Mr. Garcia will become a partner with Kirkland & Ellis, an international law firm. Before becoming United States attorney in 2005, he served as assistant secretary for immigration and customs enforcement in the Department of Homeland Security. He had worked earlier as a federal prosecutor in Manhattan, on such cases as the 1993 World Trade Center bombing; a foiled plot to blow up jets over the Pacific Ocean; and the 1998 American Embassy bombings in East Africa. Mr. Dassin, 43, ran the office’s criminal division under Mr. Garcia, and later became his deputy. He previously worked at the law firm Kaye Scholer. As an assistant United States attorney in the 1990s, he also prosecuted major terrorism and white-collar cases. President-elect Barack Obama has not yet signaled whom he might choose as United States attorney, but among early names being heard among lawyers and others are Mr. Dassin and two other alumni of the office: Preet Bharara, chief counsel to Senator Charles E. Schumer; and Mark F. Pomerantz, a partner at the Manhattan law firm Paul, Weiss, Rifkind, Wharton & Garrison.

I wonder how many folks are picking up on the fact that most of Garcia's major "prosecutions" are still pending?

This all looks like the Classic Government Political Game of Musical Chairs. Just switch from an important government position where your job was in part to uncover and undo corruption, do a very mediocre job at that, then switch your Chair ( and job ) to a high paid politically connected law firm.

In the end, absolutely Nothing or Virtually nothing gets accomplished, NOTHING Changes, and all that took place was a Few Headlines and Media events.

What happened to Garcia's big efforts trying to clean up New York corruption? Everyone talked about it. Everyone thought it was happening. Garcia even came up to Albany months ago like whoaa, something big was really going to happen.

All the major players in the State who had to leave office have simply played Musical Chairs and are getting or already have Huge paying jobs in the Private Sector where they will likely wield as much Power from behind the scenes.

Like Bruno. What happened there? Supposedly the Southern District was taking that one over but no mention of a word of that and he gets a Huge private Sector Job after three years of being Reportedly under Federal Investigation?? ( and after he had Senator Schumer up to his Saratoga Race Box, Senate Judiciary Committee member. )

Hopefully President Elect Obama and other NY Politicians will Remember what brought about the huge election victory, which was the People's Desire for CHANGE and that ALL of these Folks can get Voted out of Office just as Easy as they Came in.

What about all the Efforts for Change in the Court System? Nothing to speak of there at all. Everyone leaving office is getting huge jobs anyhow. Nothing for any real system reform. No wonder NY is in the State of the State it is.

Probably really said something when you had middle to high level members of the Mob on the blog or folks claiming to be that who even were speaking out about how bad the Court system and politicians are. Many of these folks probably know far more than the average New Yorker about how bad it really is and has been.

In Garcia's departure, New York is left with the same old same old time honored status: Grab a few of the expendable folks, pinch them, throw them in the can, but never change anything from the top down so the system never really changes. Just a few faces and positions like Musical Chairs.

President Obama: Please Remember what Political Will of the People it was that Brought about the election Results this year and same for NY Politicians. The Power of the People in the voting booth can do it again.

Well written and many points well taken!
Obama's team can and must do something here in NY STATE ....those that put him in for that desired need for real and significant change!
I for one will petition him as a voter for him and long time supporter, and with extensive knowledge of judicial corruption, to assign someone to this priority , especially as a complication of the financial disaster, that manifested from NY STATE~!

Anyone know why there appears to be a lot of conflicting and contradictory information on the Web about when the Federal probe into Spitzer and the call girl ring really began?

Anyone know the real deal? The Press Statement by US Attorney Garcia does nothing to clear up the blurry murky facts or answer the many questions raised by all of this.

Anyone know why there were print media reports that indicated that the US Attorney investigating State Senator Bruno, Spitzer's chief state rival, apparently had to get Clearance from the DOJ in Washington, DC to move forward on Bruno and yet a host of Web articles suggest that Garcia and Boyd Johnson had no such restrictions placed on the office while pursuing Spitzer?

Has Boyd Johnson been held back by DC on State corruption that implicates other Republicans? The print media indicates his office also got involved in the Bruno investigation but still no answers. Anyone know the real deal here or will this all be politics as usual?

Chertoff D'Amato???

Don't under estimate good ole' Al D'Amato and his band of thugs. Al's got his dirty hand in everything, and he knows a lot of people at the US Attorneys offices around NY. Favors are exchanged on an almost daily basis. Al needed to get this Spitzer thing cleaned up while the Bush clowns were still around.

Gee, I wonder if my story involves a few of Al's friends... me thinks it might....

Another reader of this blog mentioned something the other night which seems appropriate to bring up at this time:

What about the post on this blog from about 2 months ago that said a whole host of DOJ folks had staked their careers and reputations on something major that was supposed to happen in NY by the end of the year that would shock the whole nation or rattle the whole nation? or words to that effect

What happened to these folks? What is being said or done now? Nothing that even rocks NY much less the nation has happened as far as public corruption goes and there is only 6 weeks or so left in this year with Garcia now set to resign.

Anyone know what happened to these folks and the bold predictions? Anyone have any idea if this will prove true? Would be great if it did but current signs would lean in the opposite direction.

Question... to any in the know fighting for Justice...

Of the Judge's bonds... where are they filed and how does one obtain copies?

I would imagine they have sworn to Honor the Constitution and obey the rules of the Court.

Side by side with documented rule violations.. why is no one making claims against their bonds..

I mean really should they remained insurable if they can't follow the law?
